Failed ESA medical.

    ATOS are the company that the DWP use to scrutinise the cases and carry out the medicals.

    using the figures provided:

    100 people apply

    42 haven't had a medical (37 claims closed + 5 waiting for the medical)

    Therefore, unless I'm being particularly dim today, 58 people have had a medical by ATOS.

    39/58 of those are found fit for work (67%)

    13/58 are assigned to the Work Related Activity Group (22%)

    5/58 make it into the support group (8%)

    Then to complete this you need to look at the appeals.

    I recently read a reliable figure that 40% of ESA appeals are won and 60% are lost.

    I don't know if the 40% includes those reconsidered in the claimants favour without going to a formal appeal or not.

    Equally I don't know how many of the 39 found fit to work appeal. I would assume most do as there is nothing to lose and you continue to get basic ESA while waiting.

    If all appeal then it means that 16 of those 39 found fit to work by ATOS win their appeal and 22 get about 6 months more ESA while waiting.

    So, ultimately 34 out of 58 remain on ESA which is 59%.

    The 40% who are successful at appeal would not include successful reconsiderations as that would not be part of the Tribunal Services statistics for successful appeals because they would have been decided before an Appeal.

    About 10% of reconsiderations are successful so you can add that on too.

    OK, so of the 39 failed by ATOS 4 are successfully reconsidered and 35 go on to a formal appeal. 40% or 35 is 14 so that makes a total of 18 "wins".

    This get us to 36 out of 58 ultimately getting on to full ESA or 62%.

    A more worrying figure is that ATOS get 46% of their medicals wrong (if we assume the reconsideration / appeal process to be perfect)! In fact it is probably worse than this as no doubt a few more appeals would have been won had the claimant had good support or representation.

    And there will be those who don't bother to appeal because they've already run out of energy... (been there with DLA for my ex-husband, he eventually reapplied and got MRC and HRM)

    Go on-line and look up the ESA Act, it makes good reading.

    Find the section and quote them it.

    Yes, it could be interpreted that way also (but still nowhere near the 90% quoted earler) - just shows what you can do with stats! ;)

    There is no such thing as the ESA Act.

    And the first number quoted of 80+% is just the percentage of people who haven't been assigned to the WRA or Support groups regardless of the reason why and therefore a pretty meaningless figure - a fantastic example of the worst journalistic statistic...
