mis sold leather I feel like crying, please help

Breaches of civil legislation are generally called infringements, whereas breaches of criminal legislation are called offences.
To say that something is illegal is to say that is prohibited by law or statute. As SoGA does not actually prohibit the sale of goods which do not conform, then you cannot say that such breaches are illegal.
SoGA merely confirms the common law position that goods should conform to the contractual terms and provides a civil method of redress if it doesn't.0 -

Thankyou for all advise so far..... so if it is not illegal as such, how do you stand threatening to take them to court? Head office simply refer me back to the store, and the manageress was quite shirty, asking what exactly I want them to do, I did say if they cover the sofa for damage with the 5 yr warrenty then I will keep it, if not I would be forced to pay for it and don't think that would be fair as I wouldn't need it if I had got what I asked for, so I would like it replaced I think that's quite fair .... I'm not sure of all the types of leather they sell I went in to the sale blind if you like as i only had the swatch and the word of the salesman, he was lovely and I'm not sure how this has occurred, if they genuinely believe it is seriously durable as I don't believe it was on purpose, but I'm labelled naive alot, as I like to see the good in people. Not sure if I used debit or credit card for t he deposit can't remember does it make a difference?
The main issue I have is the manufactures leaflet states it is not a durable leather.... I have read on the internet that it is, but does that mean your bum wont wear a hole in it as quick as binded leather ? and not that it is resistant t o being scratched and scuffed?0 -
I have had a semi-aniline suite for over six years and it looks better now than when I bought it. I thought it looked too perfect when it arrived and I couldn't wait for it to have that lived in look. Coincidently, mine cost £2500 hand made (by a local upholsterer). I have two dogs and a cat and all are allowed on the furniture, there are a few scratches but as another poster points out, the colour is consistent throughout so not as noticable. Cheaper leathers tend to be coloured only on the top surface so when they are scratched they show grey underneath, mine hasn't even faded and it's in a very sunny room.
I also have never used any fancy leather cleaners or food, I clean it with Dove soap as recommended by the upholsterer.
I think you might be looking for every little mark and scratch, forget it, live with it and enjoy your new suite.

I have a mottled uneven brown leather, not not just a plain colour but the scratches or scuffs show through to a yellow underneath, which is really noticable, when sitting on the sofa so not even on close inspection.0

Linguistically, durability refers to structure and not cosmetics. If someone described an item to me as "durable" I wouldn't expect that to mean it retained its new appearance for X years. That's not to say the salesperson shouldn't have explained exactly how this leather should wear, but it does mean that scuffing and staining is not evidence of lesser durability.0

Well mine is a reddy brown and so are the scratches. My base and back cushions are all removable and inside is a reddy brown suede so I wonder if mine are full aniline hide. I got fed up of mine and it's still like new, the dog even insists on burying treats in the corners under the scatter cushions and you know how dogs scratch when they are burying things.
I don't know what to suggest other than checking the swatches in the shop to see if the underside of the leather is a different colour to the top surface.

update, I've spokewn to the store manager and after reading the leaflet and looking at a leather sample she states it is durable.... so this is her opinion and she said.. in my opinion you have been sold the right leather .... now what can i do!0
