Okay, okay...lets not fall out, any offence or insult given is retracted :)

Im not sure about SOGA to be honest, is your car "fit for purpose" and if not proving it will be the issue.

    Good luck in anycase :)

I'm seriously impressed at your forgiving nature. It was boorish and crass of him to accuse you of having scammed people. But you've risen above it.

You've restored my faith in human nature. :)

Now that is where Consumer Direct says that it is up for the dealer to prove it was roadworthy. And if the fault occured within 6 months of purchase, it is presumed that the faults were there at the time of sale.

But, is that going to be the case if relied upon within the small claims court?

TBH this is why i dont spend a lot of money on my cars.

Im like you, no mechanic, but come from a family of mechanics and know my way round a car.

Never bought a lemon yet, but if i did, (and im sure it will happen one day!) im safe with the thought that i will have only wasted a couple of hundred pounds.

Dont know a lot about SOGA/ small claims court, but im sure there will be someone along in a minute who does :)

The car is 6 years old it is most likely going to have suspension issues especially with the vast number of speed bumps around etc. My Mondeo recently needed front supension sorted and it is about the same age.

Agreed. Dont get me wrong, I would be quite happy to pay for the wear and tear had I actually used the car for than the 2 weeks or so that I have owned it. I was happy to pay for the wheel bearings, until the mechanic actually took the wheels off and realised that the bearings were in very good condition.

When the cost of repairs started to total up, I think thats the point it became unacceptable.

What a great attitude to have. Agreed, the scam comment was over the top and I apologise. I saw the comment you made and took it personal.

You have to be more assertive with the trader. The faults you have detailed can be sorted out well within half a day and at modest cost so I think he is just hoping you will go away.

Half a day? The car has been at the garage for two full days now and they havent even finished fault 1 out of the 4.

Apparantly, the injectors are causing problems. Two of them are "stuck" and they cant get them out. The dealer doesnt think that this will even be resolved by tomorrow. And definitely, the other 3 faults wont be fixed. All he said at this stage is that he is disputing they are his problem and he will "look at the faults" and make his decision.

When I asked him where the garage is and for their contact details, he refused to give me the info. I asked him again, and he refused again. He told me he didnt have to reveal this information, which I said to him obviously sets the alarm bells ringing. After we spoke about the sale of goods act and his responsibilities under this act, he said he knew the ins and outs and what he had to do, but "it doesnt mean he has to do it" was the answer from him.

So when I commented to him that Trading Standards said they knew about him, he admitted this. He said he has been to court several times too, so he has a record of selling dodgy motors. What I think his game is, is that he sells the cars and hopes they dont come back. If they do come back, he makes the buyer take it all the way to court, where the judge turns around and gives him the opportunity to fix the car, which he says he does fix the car when told by the judge. So he is selling dodgy motors and hoping they dont come back or the buyer just doesnt have the savvy to take it all the way to court.
How on earth can sellers have this attitude?!

So heres whats happening now. I have reported this to the police, for the pure fact that he wont reveal any details of the garage where it is being worked on, he wont tell me anything at all. He says its because he doesnt want me phoning the garage and hassling them. He said he will phone the garage tomorrow and get their permission to reveal their contact details and to let them know I am going to be phoning...... but this sounds completely suspicious! My thinking is that the car actually hasnt been at the garage, he has been using my vehicle as his pool car because it had half a tank of diesel in it, and he is going to phone the garage tomorrow to get the story straight with them (apparantly the owner of the garage is a personal friend of his)

The police have said that, although this sounds completely suspicious, they cant do anything until he flatly refuses to return my car. So we'll have to wait until tomorrow to see what happens. And before anyone says it was a bad idea to give him the car, he was being really decent about it until yesterday when he just turned difficult. He knows what he has to, but is refusing to do it. I trusted him because I am not dealing with a private member of the public, this is a business and he has the obvious business terms under the SOGA that he has to adhere to. If I'd have forseen this happening, I dont think I would have given him the car. But hindsight is a wonderful thing!

Anyone have any ideas on what to do next?
