It is tresspass and theft - however, as you say, you don't want to become involved in a dispute just before yu get your party wall award completed. I would advise against doing anything to the soil as it may come back to haunt you depending on the works for your PWA. Presumably you have had a schedule of condition drawn up on your neighbours property? As such your building works may be held responsible for dying plants etc on the adjoining neighbours land. You could end up having to pay for replacement plants etc if you add some strong weedkiller or similar.0

I had a similar situation a few years ago.
My neighbour's boyfriend was caught by my daughter spraying one of our bushes with weed killer. When confronted by her he stated that it was fly spray as his girlfriend did not like the insects that the bushes attracted. She then asked him why he kept his fly spray in a carton marked weed killer!!!!.
A few months later some of the leaves & branches died, then his girlfriend died not long after & he disappeared.
