Anyone know about bikes? Feel like I'm being cheated.

    • [FONT=Verdana, sans-serif]I spoke to the sachs uk rep at 3 cross, who has informed me that as I didnt get the bike serviced within the first month my warranty has become void. (this is stated as small print in the manual, I wasnt aware of this – who gets a brand new bike serviced after a month?!) Anyway, he said I should take it up with the dealer where I purchased.[/FONT]
    • [FONT=Verdana, sans-serif]I then spoke to consumer direct who informed me to approach the dealer and state the sale of goods act.[/FONT]
    • [FONT=Verdana, sans-serif]I sent the dealer a letter by recorded delivery, with a copy of the repair invoice asking for reimbursement and stating the sale of goods act. I gave them 14 days to reply.[/FONT]
    • [FONT=Verdana, sans-serif]On the day I posted the letter, (on the way home from posting in fact!) the bike broke down again, this time it was kicking up such a fuss that it actually threw me off – luckily in slow moving traffic, so I only suffered a grazed knee. The bike now doesnt run at all, without conking out 2 minutes up the road. [/FONT]
    • [FONT=Verdana, sans-serif]I immediately posted a 2nd letter, asking for a replacement bike or refund – again stating the sale of goods act and giving them 14 days to reply.[/FONT]
    • [FONT=Verdana, sans-serif]Those 14 days were up yesterday.[/FONT]

    [FONT=Verdana, sans-serif]So my questions are – should I call them and ask them whats going on? (I'm not good on the phone and havent called up until now for fear of fumbling my words and not saying exactly what I want to – I figured they would be less likely to fob me off if I sent an official letter...)[/FONT]


    [FONT=Verdana, sans-serif]Should I just proceed with a claim through the small courts via money claim online at a cost of £80 ? (which I can barely afford.. so only want to go ahead with if my case has a good chance of winning...)[/FONT]


    [FONT=Verdana, sans-serif]If I should claim (which I did threaten to do if they didnt reply within the 14 days..) should I claim for the repairs, the cost of the bike and the legal costs? Just the repairs from the first breakdown? The bike is unridable, and I dont know how much it would cost to repair – I have had enough to be honest but I dont know if I'm likely to be refunded the entire cost of the bike...? [/FONT]

    Random update: someone has offered me £1050 for the bike as is... this shakes things up a bit. Maybe I should just sell it!

    It's not someone known to either dealer is it?

    You could try contacting your local Trading Standards Dept. & asking if they can help before laying out the £80 for court action. If they can't I think I'd fight it out with them on principle. You may also want to check for future reference whether you can still be forced to use a main dealer for servicing etc (I understood all that had been stopped on cars)

    Try a car they are alot safer and have more protection
