Shocking treatment at CPW- need advice!

I'm coming to the end of my contract on O2 mid-june and i got a msg to say i can upgrade from 21st April.So i got a Nokia X6 on 18months, £30, 32GB
What i got was a 24month, 16GB £30. :mad:
Now i wouldn't mind so much but last time i upgraded they said my rental would be £15/month but what it was was £15 cashback per month every 6months...and that was a palaver and after 14day return date, returning would have meant getting a recording of the sale at £20:mad::mad: so i just let it go...it meant i could use the lump payment more meaningfully evey 6 months...no big deal.
I am annoyed that it has happened again and i'm fed up.
i like the phone and to be fair 24months is not a big deal for me and i don't really mind the length, but it is NOT what we agreed on.
on calling today i was rudely told to take it back to the shop if i wasn't happy with it!
So now i'm pretty p'd off and want to take phone back and cancel with them. They never give me any problems but both times i've upgraded they've messed me about.
Should i...
1. take phone back and cancel contract mid-june and just go straight to O2 and get a deal from them since they are my preffered service provider??
2. insist on getting the 18month thing sorted with original 'nice guy- will give me 10% off anytime' salesguy?
I refuse to pay £20 for a recording to tell me that he lied to me!!!!
3. Take a chance on one of these online 'deals' where i will most probably get messed around again...as that's just the way things go for me!

PAYG isnt always cheaper!!!
I've gone from spending £60 a month on PAYG to £17 on contract - bit of a difference there!

Payg would not work for me at all.tried it but too much cross network etc.
It was over the phone and do have 14 day return.

I've gone from £10 a month on PAYG with 300 texts included to a £15 a month contract with 300 texts, 300 cross network minutes, unlimited landlines and 3gb a month internet allowance, so it's definitely worth shopping around.
As to the OP's question, definitely cancel the contract. It's NOT what was agreed and you have rights under DSR so use them.0 -

It's not that simple. There a consumer good will side as well as a legal side.
Upgrades are not new contracts, they are extension to old contracts, although most places treat them as effectivly new contracts. It's complicated by the pahact a mobile phone contract is not really a contract it's two, one for the airtime service and as a inducement to that they supply a free handset. In theory you could return the phone and they credit you the cost of the phone back (ie nothing) but you are still bound by the contract to pay for airtime for the 18/24 months.
Also by using the phone you can be considered to be using software, and hence void any return rights under the DSR. Any phone you get from Three and use is voided from return by Three,
The DSR is so you can examine the product, and give you a similar experience to instore, ie check the blue jeans you ordered are blue not purple, or that the phone is not a kilo in weight. If you bought a phohe in store you get to look and feel it but you don't get a trail period, the DSR is akin to that experience, It's NOT a trail use period.
Really the whole issue is a mess where it's a contract for the supply of goods (the hardware) and an assosiated service (the Airtime) and really needs to go through the courts to be clarified.
The issue here was that the contract agreed was not what was put in place, nothing to do with DSR rules.
The OP needs to state that, and if need be pay for the recording, and if he's correct then should be able to reclaim that £20 for the service provder as costs if there is a breech of contract.0
