DSR covers you ?

    Correct

    OFTs BUSINESS GUIDE TO DSR

    From page 28;-

How can I resell the goods as new if they have been opened and tested by the customer?
3.59 The DSRs do not provide any general exception to the right to cancel on this point. Unless one of the specific exceptions referred to above at paragraph 3.38 applies, consumers can exercise their right to cancel a contract and return the goods to you. The DSRs do not link cancellation rights with a supplier’s ability to resell items as new.

Can I insist that consumers who cancel an order within the cancellation period return the goods as new or in their original packaging?
3.58 No. Consumers are under a duty to take reasonable care of the goods while in their possession as discussed in paragraph 3.44. The DSRs allow consumers to examine goods they have ordered as they would in a shop. If that requires opening the packaging and trying out the goods then they have not breached their duty to take reasonable care of the goods.

well well well, very interesting posts. Especially the Wynsors employee. Thank you.

'Not put me off shopping at Wynsors?' LOL. How can you buy shoes online and not try them on????

I would never recommend that anyone buys from these shysters again. I wore these shoes, no - correction - tried these shoes in my own house. I trusted Wynsors on the size but alas, when I found they were mis-sold and wrongly sized (at Wynsors admission) I took them off and sent them back. I actually e mailed jo@wynsors asking what to do but got no reply after 2 weeks so I went back to the site and spent £4 postage sending them back. I don't want my $ back, all I want is a pair of UK size9 Adidas trainers - not 8, not 8.5 but UK9.

I will fight on as I really, really can't afford to lose £35.
Can anybody suggest the next step - Trading Standards, local MP?

Thanks again for taking time to reply

Thanks. I'm going to write to the company again, then take it further.

I'd certainly recommend people not to buy shoes off the internet if you arent allowed to try them on for a reasonable amount of time. Especially if some manufactures sizes are not consistent and shoe sellers keep it to themselves.

I will let you all know what happens.

    @Balconyboy

I work for wynsors so thought I would dig deeper and see what the problem was. The goods are indeed labelled as a US 9.5 and a UK 9, it is ADIDAS who label them as this size though and not Wynsors - however ADIDAS sizes are know within the industry as being a small-fit.
The goods were inspected by our quality control manager who deemed them to have been worn, wynsors accept returns on any goods that are unworn and fit for re-sale. I hope this helps and has not put you off shopping with us.

Well, it will certainly put people off from buying from them if this is their attitude & response........
