Wynsors World Of Shoes - Help please!

Earlier month I bought 2 pairs of trainers off the internet. Both size 9 (US10). One Puma pair were a perfect fit but the other size 9 (Adidas) did not fit and had US91/2 on them which is NOT UK size 9. So I tried them on obviously and wore them in the house for 10 mins just to make sure but they were obviously not the correct size so I sent them back (at cost of £4. Now Wynsors have returned the original, mis-sized pair to me as 'they have been worn' (like you can if tell shoes bought off the net fit by not trying them on)?
So, being a fighter (and a low-wage earner) I'm up for a fight. I want my shoes and am not going to lose out on £35.
I ordered size 9. What came was marked size 9, but was not. Can someone kindly advise me where to start (Consumers !!! or Trading Standards?

Can't really help but I now concentrate on European sizes when buying online as I find this gets me closer to what I am expecting. I have found UK sizes can be all over the place.
Interestingly bought a pair of Hunter Wellies size 5 for my neice but she complained they were way too big. My OH is now wearing them and she normally takes a 6.5/7!! Fit great so she says.0 -

I work for wynsors so thought I would dig deeper and see what the problem was. The goods are indeed labelled as a US 9.5 and a UK 9, it is ADIDAS who label them as this size though and not Wynsors - however ADIDAS sizes are know within the industry as being a small-fit.
The goods were inspected by our quality control manager who deemed them to have been worn, wynsors accept returns on any goods that are unworn and fit for re-sale. I hope this helps and has not put you off shopping with us.
It doesn't really matter who re-labels them, though - the op bought them from yourselves, and as such the contract is with yourselves. The OP isn't within the industry, and anyway, whether people within the industry know that Addidas are smaller is immaterial. Selling goods that aren't a UK 9 *as* a UK 9 means they're not as described and hence the OP's entitled to a refund under the sale of goods act, whether the shoes are worn or not.
EDIT: In fact, your post has confirmed that the OP should get their money back. You've admitted that the shoes that were labelled as a nine are a non standard size.0 -

I am personally a size 9 and also own a pair of these trainers.
Blooming Heck Adidas only make ONE style of shoe!
I think there is a classic case of Cow Pat going on here.
I have been shoe shopping with friends and they have tried the same blooming shoe on 5 times probably totally an hour of "wear" and they havent had to buy the shoe!
Spooky how a representative signed up on the day a complaint was made.0
