What are the rules for LHA for live in carers.

The question is: what are the rules for LHA for live in carers.

The number of rooms my family is entitled to is 2. I'm waiting on renewal of DLA HRM/LRC. I get ESA, LHA, CTB, CTC and CB. LHA currently pays for a third bedroom for my live in carer.

Apologies for completely editing all my posts but the question is not: how many rooms is my family eligible for / what do you think the rules might be / what do you think the rules should be / do you think I'm entitled to any care etc.

    MRC is for sustained and continual day time needs. surely for a live in carer you would have to prove 24 hour needs? I'm not saying you shouldnt have a live in carer, just that , if its your choice and not deemed necessary then u might not get extra for the third bedroom.

    Middle Rate Care is paid for sustained and continual needs for EITHER Day or Night.

    Hight Rate Care is paid when 24 hour care is needed

    It is not quite that extreme:



    In order to qualify for the higher rate you will need to show that-

    you need frequent help from someone else in connection with your bodily functions during both the day and the night

    or

    that you need supervision from someone else during both the day and night in order to prevent danger to yourself or others

    You will also recieve the higher rate if you need help with bodily functions during the day and supervision during the night or vice versa

    In order to obtain the middle rate you need to show that you require help or supervision either during the day or during the night

    I thought LHA was re-assessed once a year. If this is the case then you are asking, at renewal time for the LHA what is the criteria for being entitled to an extra bedroom. In other words, is there a rule which states that you automatically get an extra room on LHA if you qualify for MRC or similar?

    You're arguing as to what care needs you all think I might have and how that might affect my DLA and whether I'm morally entitled to a carer but that isn't the question.

    If you are under 25 then there are rules that mean you can get the extra bedroom if you have a live-in carer. There is nothing for over 25s.

    Googling around, the only way to get extra bedroom entitlement for over 25s, is for a discretionary housing payment to be made in acknowledgement of the fact that you need an extra bedroom for a carer. There doesn't seem to be a fixed criteria for this, hence "discretionary" in the title.

    if housing can't tell you, how do you expect anyone else to know?!?
    oh and I personaly find you a tad on the rude side so if nobody else wants to post advice I can totaly understand why!!!
