We have compiled a letter of the questions we want to ask them, Does this look ok or does it need more work?

On the 05/02/2010 your company was appointed by the Halifax Home Insurance team to attend an incident which had occurred at our home.
We explained to the technician when he arrived that there was a problem with the soil pipe and that we were expecting a drainage team to attend the property to unblock the drain. We also explained to him that this was not clean water but this was contaminated water. The technician cut sections of carpet out of the dining room and bathroom and removed them. He then sprayed a small amount of sanitizer to the floor, shower tray leaving excrement in the bottom of the shower tray he put a dehumidifier upstairs in the bathroom, one in the dining room and he also installed a blower in the kitchen.
We would appreciate if you could answer the following questions.
1, why did your technician repeatedly comment that in order to keep the claim under £1500 so we would not be appointed a PCC. When he knew this was contaminated water.
2, Why did your technician install a blower in my kitchen which only spreaded the contamination further.
3, Why did your technician not treat this incident as contaminated water instead he treated this as clean water.
4, whilst the blower was in our property all of the occupant became poorly with stomach upsets and diarrhoea.
5, Why was we not removed from the property whilst this work was undertaken.
6, why did your technician not remove all soft furnishings to be destroyed?
7, why when we explained to your technician on his second visit that we could no longer use the shower or the bath as there was effluent appearing in the shower cubical when showering. There is also waste reticulating through the Jacuzzi spa bath system when the pump was turned on. Did he not think to have the small drainage cleaned? He was aware that this was the only bathroom in the property and that we had to visit relatives for a shower which is a fifty mile round trip.
8, why did your technician empty the dehumidifier into the kitchen sink?
9, Why did your technician after being informed that the drainage company re enacted the incident again did he not sanitise again.
10, why when we told the technician that we had been poorly and were still poorly did he not think of the consequences of blowing contaminate across our kitchen which we were still eating out of at the time.
11, why was the area that was contaminated not sealed off from the rest of the property whilst this work was being undertaken?
12, the technician knew that the dining room table and chairs had taken a direct hit from the contaminated water but did nothing to clean it.
We are in contact with a solicitor although we are reluctant to go down the route we feel that we would like to bring an end to this matter as swiftly as possible.

Forget the "we are in contact with a solicitor" point. Either you are - in which case get the solicitor to write - or you are not.

Tell me about it, He has now said that we are probably best looking at the insurance policy to see if we had legal expenses covered and that way we could sue munters through the Halifax. He said that there is a definate personal injury claim and that Halifax should of moved us out of the house but the twist in the tail is that Munters never told Halifax that we shouldn't of been in the house as he was treating it at clear water.0

I think your solicitor needs to go back to law school. There is a 'causation' issue here which he needs to have a little think about.0 -
Just a small update for you all, The bath came back on friday got fitted we filled it with hot water and turned the pump on only to discover more of the proverbial firing out of the jets like you had a vindaloo the night before!
The new sink got fitted thats leaking
The new light fitting in the dining room was buzzing
On monday they had to come back to fix a few things and we mentioned these problems to the builder, we emptied the bath infront of him so he knew we hadn't done anything to it we filled it again with hot water turned the pump on again and it was even worse than it was on friday!! He was nearly physically sick!! Had a look at the sink and silicone sealed it in.
He said he would ring us back in a hour and he kept to his word less than a hour later he was back on the phone telling us to look for a new bath! So we're on the search for a new bath. The sink is still leaking and an electrician came to look at the light in the dining room he took it down and there was water in it! so I'm guessing we still have a leak somewhere so been left without a dining room light until it's safe
