Home made DMP and reclaiming charges

Hi all, I'm a year into my home brew DMP where I arranged the plan with the creditors directly.

I'm thinking of trying to reclaim some charges but wonder how it will affect my DMP. Would any of my creditors refuse the payment offer if I went down this route?

    The likelihood is that they would take off any monies reclaimed off any balance outstanding.

    That wouldn't be a problem, any help with that is great but are there likely to be any repercussions if I went down this route? Just concerned because I don't have any debt management specialists behind me at the moment.

    Reclaiming didn't have any impact on our DMPs.
  • ok updating on this now after sending the template letters to both HSBC and Halifax. Halifax responded with a letter saying they are collating all of the info, yet to be received whilst HSBC have offered some cash straight away. £137 to be precise.

    I'm sure I read somewhere that by offering this, they are trying to cut their losses here a larger claim would likely be successful, and that i should write another letter to re affirm my original request for the list of charges?

    Can anyone varify if this is the best way to go or should I just accept the money as it is better than what I started with?

    The Subject Access Request to HSBC should have produced the statements from which you would get a figure to reclaim. If they haven't provided them then they need to before making you an offer that you cannot verify.

    Do you not have your own list of statements? I would ask them for a full statement breakdown for the period in which they have refunded and not just bank charges information. If they have said that it is their final response then that is nonsense cos you haven't as yet put in a complaint for the return of any charges.

    Have you actually made a DSAR request and paid £10 or have you just asked for a list of statements? If it's the latter then they have complied. And the bank will treat a request for a refund of charges as a complaint as it is an expression of dissatisfaction. If you weren't dissatisfied with the charges that have been applied you wouldn't be asking for them back!

    The template on MSE is very clearly geared towards a full DSAR and not just statements. Even if it was statements the list of charges is not DPA compliance since statements may be asked of a bank for various reasons not bank charges related.
