I don't know the circumstances, other than his wheel and left wing is all damaged and car had to be towed away.....

i don't think he will have helped by lying about being on the phone, but I guess the deal is still pretty much the same careless driving.....

This forum was not set up to advise people how to get away with crime.
Perhaps he will realise that the law is made for a reason and he had a lucky escape if no-one was injured. If his employer knows he was on the phone they can probably sack him for damaging company property ( His car) becasue he was not taking proper care when he crashed.

I was asking what was likely to happen to him, not how to advise him on how to get away with a crime....

how can the police prove it if he has his works phone and one person says on phone and one person says not

This is the bit that prompted my response

That looks like someone saying "can he get away with saying he only has the one phone who can prove otherwise?"

I was hit from behind by a speeding idiot on the phone a few months ago still got the injuries to remind me...the pain killers are probably clouding my judgement

When we were hit last year head on glancing blow to us and he then hit and wrote of the car behind I don't know if he was on the phone or not but he suddenly had amnesia. Didn't help him still got a 6 month ban for reckless driving I believe.

How do you know the accident was his fault?

The police aren't stupid, they'll have prosecuted hundreds of people who try to pass off a different phone.
They'll ask for his personal mobile number, and simply check that as well if they want to.
From what you have said, his company know he has another mobile, and they're not going to lie for him.

I don't but the OP is implying that it was his fault by the questions being asked.

    well update

he has to work extra hours to cover the excess on car insurance and is going to police today to confess he was on phone - to take what punishment comes his way

apparently the guy that hit him ran a red light...

not sure what the bit about "she will start going out with someone who owns a reneault" is all about
