    I do a consumer panel type slot for radio and my co guest is Trading Standards. I run the scenario by her and in her opinion there is a case to answer. Certainly with the Rome Convention giving the UK consumer the same rights helps. It is also positive to say that Fotovista (France) and DGS (UK) are monitoring things very closely.

    By next Monday most of the LBAs should be reaching the 14 day limit. Please keep me posted on the replies you receive.

    They honoured my order for 85. Chuffed.

    Today at 13:02:42
    Rang up and i should be getting mine by the end of this week.... result

    looks like they cant dig themselves out so are honouring the original deal

    The UK government bodies have detailed information regarding overseas purchases via the internet

    This becomes legally binding on the company and they cannot hide behind their own countries consumer laws. The EC law ALWAYS takes precedent
    Though always beware of the line ''' The existence of a right of withdrawal ''' - check the terms on the site. Such a clause would be something like 'in the event of a clearly mis-priced article, we retain the right to withdraw the offer of sale'. If there was no such term in the conditions then it is straight-forward. There is now - but was it there when you bought

    of course it will remain in confidence.

    As the 14 day expiry passes I will be adding a page to the site with the wording for the small claims to get the next stage rolling.

    I assume from the fact that there have been no postings that no-one has heard back.

    It would appear Pixmania are "investigating" the issues and will request that you hold off further action until they reply, aiming for 21st May.

    They ask that you write to the France address, however, I feel all communication should be made to the UK address listed on companies house as

    a) Pixmania UK are investigating
    b) DSG UK have been trawling these forums and lossofbargain
    c) You can verify your recorded item has been delivered in the UK
    d) You will need to serve legal documents to Pixmania UK address
    e) Article 5 of the Rome Convention should bring protection for UK consumers. Having seen some of their replies speeling off French law, ignoring Article 5, you are better off dealing with Pixmania UK as court action will be defended in the UK at your local court.

    I will update the website with the info posted above.

    In fairness, we should be seen to give Pixmania to 21st May 2010 to formalise their investigation. I would expect their final reply to be heavy hitting and defensive, possibly trying to put you off legal action.

    I will update Loss of Bargain on the weekend of the 22nd/23rd May 2010 with how to file a small claims against Pixmania if they fail to resolve to your satisfaction, your complaint.
