in reply to some of the negative responses i had the accident at work what was the full responsibility of my employers i had never been a SICKIE up to that and it has left me incapable of working at present
If it the companies fault they should be morally paying you your full wage which includes holidays however we know that some companies don't have morales.
What are they paying you at the moment? SSP, 1/2 wage, full wage?
I'm also presuming you have a no win no claim going through or gone through with them?Always ask ACAS0 -
i got ssp for about 3 months then i had to claim incapacity from nov 07 to present they didnt offer me my holidays in my redundancy packet0

You should be paid for the statutory holiday you accrued for the whole of the period that you were on long term sick.
You could get in touch with your former employer to give them the opportunity to put things right.
If they decline you can make an employment tribunal claim under section 13 of the Employment rights act (unauthorised deductions).
Be aware that you'll need to claim within 3 months of the fault.
