Problems with sleepmasters damage

Sleep masters delivered a bed to my house in the process smashed a picture (knocked it from the wall). I gave them a costing for replacement, as i no longer have the reciept, they will not pay for the full cost only 50% stating they want a reciept - I am unable to pay for the full cost of the picture as money is very tight as I am on extended maternity leave. I have copied their response below - I asked for their insurers details to claim with them.

Any advice would be greatly appreciated.


We have accepted liability for the damage dome to your picture frame and acknowledged the fact the driver signed the PDA on your behalf.

In order to draw this matter to a close may we reitterate, without proof of purchase of a replacement picture frame we will not be reimbursing you the cost. Naturally we understand you are not able to purchase it at this time for financial reasons, therefore we extended our offer to pay 50% now and 50% when you provide the receipt.

This is our final offer in this matter. We can arrange for partial refund of the frame within the next 7-10 days once you contact us to confirm acceptance.

    I think you've misunderstood what they're offering. They don't want the receipt of the original pictaure, they want to see the receipt of the replacement. They're saying that they're not going to give you the full replacement cost upfront but they will give you 50% now and then 50% when you've purchased to new picture and supplied them with the receipt. In effect you will be getting the full cost back, eventually.

    Yes, I quite understand this, they want to give me 50% now & 50% upon obtaining a replacement. As stated dont have the spare cash to pay 50% up front i am on extended maternity leave with very little income. Also, should they not either replace the item (for which i have given them details) or refund in full why should there incompetence/damage become my problem

    Exactly how much money is involved. Can't you pay using a credit card, then you could send them the receipt and hopefully re-imburse you before you next credit card bill has to be paid??

    What I dont understand is that they have admitted responsibility & wont refund or replace?

    Is that an exact like-for-like replacement for the damaged picture? Bear in mind you are under a legal duty to limit your losses. How long have you owned the original, also bearing in mind that an insurance claim may not pay out of a like-fo-like replacement.

    The quote is for a very similar picture as the other is no longer produced!

    That's a bit of a pain OP, but I can see how they would want some proof of what it cost before parting with their money. The solution they have offered seems quite fair, did they put a time limit on the offer? can you not hang on for a while until your finances are a bit better
