Hi Everyone
I couldnt find a relevant place to put this so seeing as i use this forum the most i put it in here and hopefully admin can move it to somewhere relevant.
Myself and my partner have been with Elephant for our car insurance for 5 months, always paid on time by direct debit, in the last 3 months they started making mistakes. Firstly in February when we owed them 102 they debited 544 from our account. We contacted elephant who were very unhelpful and told us the only thing they could do is credit the extra to our account meaning we wouldnt owe anything for the next 3 months. I told them this wasnt possible as we dont have that sort of money spare, but they wouldnt budge. I then phoned the bank and told them that it was a mistake and i needed the amount minus 102 refunded, they told me they could only refund the whole amount or nothing at all so we went with the whole amount which was duly refunded.
I then contacted elephant to pay them the 102 by debit card, they told me they cant accept debit card payments, 3 people i spoke to and they all said the same, so i said i would send a cheque, they dont accept cheques either apparently. They said all they could do is add the amount was added onto next months which was March, meaning the amount that was debited should have been 204, however this time 792 came out, leaving us !!!!!!ed again so we had to go through the same thing.
They have now written us a letter saying we have defaulted (not happy bearing in mind my credit rating at last look was 994/1000 and that we are to pay 1035 (the amount upto the end of the contract in july) by 24th April, which we do not have. This is their mistake, they point blank refused to accept payment from us, we even had a cheque returned to us with a letter from a Mr Lanley saying they cannot accept cheques. They will only accept DD but they !!!! up everytime they take the monies. Funny thing is, now that it says its gone into default on the bottom of the email it says we can pay by cheque/credit/debit card..... strange that, everytime we tried paying by them methods previously we were told this was not possible.
Please advise on the best course of action, i do not want a default on my file and i have done nothing to deserve one, we have done everything we can but are hitting a brick wall with them.
Thank you

your best bet is to lodge a complaint with the FOS at this point, you could take them to court but that's probably unnecessary right now.0

Would be better posted on the Insurance & Life Assurance board, where you will receive more response than the Budgeting & Bank accounts board.Don`t steal - the Government doesn`t like the competition0
