A laptop, or any computer for that matter, can easily be restored back to state it was supplied even if it has been used so that wouldn't be an issue. The DSRs specifically do not link the consumer's cancellation rights with the suppliers ability to resell the returned items as new.

just out of curiousity, is that common practice? just there's been a few threads on here about the likes of PC world etc selling used stuff as new!

What should normally happen is the retailer would return the laptop back to the manufacturer, they shouldn't really be selling the item as a new product, maybe a manager's special once they've wiped the hard-drive and reinstalled the OS. After all, you wouldn't expect to pay full price for one of the display models that are dotted around the store.

Sorry but seems they are being perfectly reasonable about it! someone would have needed to be in to sign for the laptop so I'm assuming you could manage to get someone to be in to go through the fault on the phone? or do it on your day off, I'm assuing you don't work 7 days a week?
I don't know what else you expect them to do?

No i dont work 7 days a week but they are not open weekends, and yes i have my next door neighbour who would be in to collect for packages but she is 75 so a bit hard to ask her to set up the laptop for me! And yes i could take a day off but if i am only limited to 7 days to return the item in, i will not get the holiday approved.

I personally dont see why i need to contact acer to get them to prove there is a fault, surely they can do that?

And with regards to second hand stock being sold in PC world, yes that is correct. All their display stock are second hand computers if you use some of them they still have personal data on - havent even bothered to restore the settings.

Yes i installed all the downloads it required to run, i will see about DSR thank you everyone

For the reference of not connecting to the internet in a PC World shop, you don't tend to go in and pick up a box and leave - there are demostrator machines, whilst maybe not directly connected to the internet, they are removed from the boxes and setup for the demonstration which involves more than just pressing the power button. (usually OS pre-configuration questions etc)

I think it does matter that it's been opened and used!! they ask you to return it in the condition in which you received it, if someone has been using it for a few hours then it isn't new anymore, you'd have to return it as faulty and that is hugely debatable...
As for the webcam issue, well sorry but you should have taken more time to read the spec. By all means call the company you purchased it from but I think they may make it hard for you to return

They can ask you but cannot demand you. I've seen your (helpful) posts around here, and thought you would have already known this?
Can I insist that consumers who cancel an order within the
cancellation period return the goods as new or in their
    original packaging?
3.58 No. Consumers are under a duty to take reasonable care of the goods
while in their possession as discussed in paragraph 3.44. The DSRs
allow consumers to examine goods they have ordered as they would
in a shop. If that requires opening the packaging and trying out the
goods then they have not breached their duty to take reasonable
care of the goods. In these circumstances you cannot insist that
consumers return the goods as new or in their original packaging.
You may ask consumers to return goods with the original packaging,
but you cannot insist on this. In the case of goods such as earrings
that have hygiene seals, you may require consumers to exercise
reasonable care by not removing the seals when examining them.
If you ordered it, but forgot you needed a webcam - yes their fault for not checking the specs, but DSR allows you to return for this kind of reasoning.

As for being "used", at what stage is an item considered opened or used? Maybe some clothes don't fit, but you try them on first... DSR means you can return it, but apparently these are now used? I think turning a laptop on can be considered trying it.

    For OP:
A bigger GHz doesn't make a processor faster - that is just clock speed and how fast a processor is varies depending on processor. Even then, Processor, RAM doesn't mean a machine will be faster, OS's are different, (included) software is different, different services, drivers for hardware (hdd, chipset, hdd) are different. As for HDD size... size doesn't mean it's faster - some of the safest drives are actually the smallest (look at SCSI/SAS sizes and SSD).

As you have 4gb of ram I assume you have a 64bit version of windows, again this is different, if you have 32bit then you will only actually have 3.5gb of ram available (although there are exceptions). What was teh first version of windows you had? XP? and new one is Vista? That's most likely your problem, go back to XP or upgrade to Win7.

OP, can't you phone Acer tech helpline from work (even on your break/lunch) and explain your circumstances, they may well be willing to just arange collection and test it themselves, suppose you won't know until you ask, they might have a decent customer service dep.
Or as people have suggested package it up and return to Aditions, the only thing with doing that is they may contest it has possibly in their eyes been "used" as you were on the internet with it yesterday and today and also the day before (don't shoot me I'm just stating) I don't know how much usage of it they would accept before classing it as "used" and no loner able to return under DSR. Hope it gets sorted whatever way you decide to go

The 'seven days' is seven working days to notify them that you plan to return the laptop under DSR.
You have thirty days to actually get the thing back to them.

    +1
Even if you are not perfectly sure you want or can return it under DSR, put a request in now... if they say yes they will replace it (regardless of if they have to or not) then bonus, if they say no, then at least you have the time to look up if you are entitled to it - then they cannot say your request was too late.
