    this is so typical of the utter rubbish spouted by many local authorities who think they know something about housing law.

    What gives a housing officer from the council the right to give "advice" to a private landlord about his chances in court ???

    this HO seems to be saying "no dont bother taking them to court, we know you will get possession, and then we will have to house them and we dont have any houses and our B&B budget is empty"

    i NEVER get involved with council schemes... i once applied for a property to be accredited.. never again... never never never again....

    these "surveyors" employed by the council to look at the private sector, really have no idea at all what happens in the real world, they look at rules and regs and stick to them like s*** to a blanket - showing no common sense or willingness to interpret in a sensible manner... little hitlers..

    To clarify, the Housing Officer was speaking about their chances of securing a possession order as they had to bring the case to court, not the landlord, since the council had the AST with the tenant. They said that they had virtually no chance of getting the PO unless they were able to demonstrate they'd done their utmost to house the tenant and the tenant was being unreasonable in rejecting the properties they were offered. They were adamanent that the local court had a history of rejecting eviction notices brought by social landlords when it involved families.

    This was subsequently verified by a legal expert who said that local authorities, unlike private landlords, do come within the Human Rights act which limit the opportunity to evict tenants with children.

    I like it best when they ring up and in a moron chav voice say: "Do you accept DSS? 'n' I've got 3 dogs, will that be alright?" Ermmm, no love, I don't think so somehow. Some of them are lovely though, I did a move out for a girl last week who I moved in 2 years ago when she was just 18, pregnant, and dependent on housing benefit. I've never seen a property so clean!

    i once had a couple on benefits look round a property to let, and he had a huuuge ghetto-blaster on his shoulder and wanted me to hear his last landlord's recorded phone response to the tenant's threat to kill him as the landlord had apparently insulted his wife.....

    meantime his huuugely pregnant wife is digging him in the ribs with a plaintive "shurrup kev - the lady dont wanna hear all that"

    too right i didn't .........

    they did not get a tenancy out of me that day.....


    i have several exceptionally marvellous tenants on benefits, ranging from 24 to 69....

    i take each person on their own merits....

    I wish I had as much to spend on rent as LHA would pay out ... as it's based on average rent it's pricier than I'd be looking to pay in most areas. As I pay my own way I have to make every penny count. That extra £50-200/month I'd have to pay out for "average rent" makes a huge difference.

    LHA has cost local councils a fortune in some areas, but in other areas rents are significantly less than when HB was in operation....

    Worst bit is - the relative I mentioned (a cousin, very close in age to myself) has never done a day's work in her life - and when pushed to get some work, clear her rent arrears and sort her life out... got pregnant as her response. All rights, no responsibilities. The cable telly example comes from her sitting there happily bragging she'd got the cable put in - while at the same time sitting there moaning the fact she was up to 6 months in rent arrears again (after my parents had paid them off for her previously).

    Makes me mad because I rent, I've on occasion had to claim housing benefit (I'm a supply teacher - work's very erratic at times - better since I picked up sidelines to add to my income like tutoring), and I also dare to have a pet wonky moggie... I get tarred with the same brush as these idiots. Means ALL of us who rent get a worse deal, viewed with more suspicion, treated worse by landlords and letting agencies - until we prove otherwise. Difference is - all I've heard growing up is "you make sure the roof over your head is paid for before you spend money on anything else" - !!!!!! it's not blooming rocket science.

    Cousin's been evicted once - is in arrears again... but this time has the baby get out of jail free clause.

    Yes I'm bitter - I've worked all my life and can't have children, run around like a looney trying to get places to rent, work my rear end off - and then you get parasites who just sit on their backsides, ride evictions to the brink and know that the rest of society will pick up the pieces while they pay for cable telly. Incidentally - yes I do in fact HAVE cable telly - but I also posess the braincell required to realize that you don't get that if you can't pay your existing bills.
