Rights over damaged shower tray

Hi all,
Looking for some advice over a damaged shower tray I ordered from an online company this time last year.

When the plumber came to install it he noticed it had a hairline crack near the waste hole. Due to the schedule of work involved with my house renovation and not wanting to be held up, the plumber with my reluctant agreement decided to repair the hairline crack and install the tray rather than wait for a replacement (the retailer are somewhat notorious for having poor customer service according to threads on here!)

Inevitably the repair hasn't been successful, and early this year we noticed the shower was leaking into the room underneath.

I have contacted the retailer and they claim that as I had installed the damaged item they were not liable for a replacement.

Is their stance correct? I'm hoping that the fact that the item was not fit for use would mean I could get a replacement item?

Any advice appreciated, apart from don't install damaged items, I think I've learned that one myself now!!

    Did you contact them at the time it was noticed, before it was installed ?
  • Yes, I had to contact them to request a replacement for a faulty heated towel rail (noticing a pattern with this company?), and when I emailed them I also mentioned that the shower tray was cracked but that rather than seeking a replacement at that point the plumber was going to attempt to repair it.

    Most plumbers merchants will not give any refunds on suite items once installed although they should have made this clear when you first contacted them.

    It seems that you accepted this good with the fault and have put it to use. Furthermore, as you had a plumber who is separate from the company repair it, then you can't really hold the company to blame, can you? An analogy would be buying an electrical item that didn't work, but instead of getting a replacement you get a local store to fix it. By doing this, you have invalidated the warranty and when it goes wrong you can't do anything.

    In this case, you should have waited for the replacement, I'm sorry to say. By tinkering with the product, I doubt you have any rights.
