Bank charges with Lloyds TSB help needed please!

I am writing this on behalf of my boyfriend. He went to university for 3 years and literally lived in his overdraft (or rather lived over his overdraft) so he was constantly being charged for going over his overdraft. The charges amounted to £850. At the time he was living away from home and he had no money coming in. We have written to Lloyds twice about this and the first time they said the charges were fair, the second time they said they still won't refund the charges as they are fair and they would be in touch about debt repayment plans. Basically they are saying he probably is in financial hardship but they won't repay the charges!!

My boyfriend is in debt to his parents by about £12,000 (car loan and uni accommodation and living expenses), student debts of £12,000 and a Lloyds overdraft of £1750. He was regularly going into his HSBC overdraft but he is from this month out of this.

Please can anyone advise of what we can do next? Do we go to the Financial Ombudsman??

    Are his parents expecting your boyfriend to repay the money that they have given to him? That is not a priority debt.

    Which he does not start to pay until he is earning half the national average in wages so he can defer payments

    With all due respect to you, if HSBC have said he is in financial hardship then I have to say I don't see it the same way.
    Is he paying any money towards his overdraft at all?

    Yes they are expecting him to pay them back.. The interest on the student loan is £50 a month which is very worrying considering he doesn't even have a full time job. He is paying £25 a month towards his overdraft. The financial hardship was more when he was at uni 2 years ago when he couldn't afford to live and his DD were being returned and he was being charged.

    How much did he splash out on that car at the time he couldn't afford to live???

    Did he speak with his student University over hardship funds?
    Who were the Direct Debits to?
    What did he do at the time?
    Did he approach his bank?
    Does he actually have to make any payments towards the student loan currently(that is important and not how much is accruing)?

    He paid £3000 for a car so he could get to his job (he did buy a cheap car but it fell to bits) rather than live on the dole! He didn't spend it all on beer, he was living away from home and paying rent, bills and food.

    He isn't paying back his student loan atm cus hes only earning £10,500. He spoke to the bank on several occasions and they just increased his overdraft for him. The direct debits were for rent and bills and his mobile phone.

    Increasing the overdraft does mean that the bank did do what they should have done unfortunately so I cannot see financial hardship. I would look at the reclaiming route and read it very very carefully.

    For Chipbeck: Unfortunately, since November 2009, there is a lot of manure to trawl through so thankfully I have soap and water when I come on the forums. One day I hope that we'll see the flowers pop up from the current weeds ;)
