  • Thanks CIS, I've just been talking to my pal on the phone and he asked me to thank you too.

    I think we should get the tenancy agreement and send them to the LA with his daughter's letter and some utility bills addressed to her.

    There should be enough evidence that he was not living there. It's only a small ex-council 2 bed flat.
    We are going to a lot of effort to be sure that he pays what is fair but not more than he owes. I 'interpret' for a few people who have problems with communication and the LA wanted his permission to talk to me, which I will do if necessary, but I'm in favour for people being their own advocates as much as possible - if that makes sense!

    I'm off now to meet my daughter from her weekend job. You have great remainder of your Sunday! And I'll let you know what happens

  • Hi, I am considering a Debt Relief Order and was wondering if you could help with a few questions I have. I know I will need to call to discuss fully but I live abroad and not easy with the time difference so I want to be prepared before I call.

    Here goes:

    1. Can I apply from outside the UK? I have been living in Canada since Jan this year.
    2. Can it all be done by email / phone?
    3. What paperwork will I need to provide for the DRO?
    4. I can get family to pay the £90 fee so can the paperwork for this be sent to someone else?


    5. I do temp work through an agency - how do I work out income for budget planner - do I do an average over last 6 months or do I do based on income from current job?
    6. Reason for looking at DRO is relationship breakdown. Our only joint debt is a bank account with overdraft. My ex-partner wants to keep this account and pay the overdraft as it is his only bank account. Can I leave it off the DRO?

    Hello,

    I wanted to get other people's opinions and advice on a situation my wife is faced with. She ran up a Credit card bill with Virgin Credit Card and went over her £9000 limit. I discovered this in Feb 09 and made her call Virgin to sort this out. The problem is because she is over her credit limit they are charging ridiculous amounts of interest. She has since called them 6 times in an effort to come to some sort of arrangement to reduce the problem for her however they do not help her or offer a solution. She pays between £300-400pcm to Virgin and despite this her balance has risen from £10400 in Feb 09 to £11200 last month. Surely they have some moral obligation to help her - especially as she called several times to ask for help as she couldnt afford to pay more. She has paid over £6500 since Feb 09 and yet her balance has increased £800. What can she do?

    Thank you for your message.

    I would recommend that your wife has an appointment with the CCCS so we can help her put together a detailed financial statement and look into her options. Creditors unfortunately are under no obligation to stop the interest and charges.

    Once we have helped your wife complete a detailed financial statement we will be able to see how much she realistically has left over to service her debts and then we can see what her best options are from there.

    Hi,
    if I give a brief outline of my situation, I hope someone can help.
    I have 2 loans, totalling £20,000. 2 credit cards totalling £12, 000 plus a £1000 overdraft.
    Until now, paying them was fine (although I am always skint), but my fiance has had a baby and been made redundant, so I am now paying for everything (mortgage, utilities, sky, phone, everything) as well as £269 maintenance for my other kids.
    I earn £2044 a month, which is a fair amount, but pay out just about that much in all bills.
    I can't afford to buy any clothes, my car is a wreck and I spend nothing on myself.
    There are 2 kids and 2 adults in the house, and my other 2 kids (and ex-step daughter) stay every other week for 2 nights.

    I know this is a bit of a ramble, but I am living off my credit card at the end of each month and making my debts worse.
    What, if any, is the best way out.

    You could consider making a complaint to Consumer Direct who are part of the Office of Fair Trading as in the debt collection guidelines it does state “pressurising debtors to sell property, to raise funds by further borrowing or to extend their borrowing” (2.6b)

    You have posted in the right place. A CCJ would stay on your credit file six years from the date it was issued.

    I'm digging myself deeper & deeper into debt and coulddo with some advice. I'm around £22000 in debt which is made up from the overdraft on my account, a loan with my bank and am almost maxed out on my credit card. I rent my home and don't own a car, would an iva be the best way forward?

    You would need to have an appointment with the CCCS so we can help you complete a financial statement and look into your options. An IVA is only the best option for a small percentage of people.

    Can anyone from CCCS tell me how long it takes to set a DMP up please?

    I sent all of my docs off and had an email last week to say I'd missed a couple of things so I sent these on Friday 1st class.

    How long do you think it'll be before I hear something?

    Will it all be ready for me to make a payment on the 1st of August?

    Just getting a bit nervy.
