    Hello Everyone

    I have done the debt remedy online questionnaire with CCCS today but I'm a bit unsure as to how easy it would be should my figures alter suddenly.

    My problem is that my DH is currently off work sick atm and his company pay his basic wage for so long until it runs out and then all he gets is SSP.

    So if I include his contributions to me but they were to drop down significantly in say 5 weeks time would this be OK or should I just wait?

    I wanted to start the ball rolling as I've already missed payments on my loans and catalogues etc.

    Any advice please?

    I have a DMP with payplan for six months now. The monthly payment is slightly manageable for me and I cut my crazy expenditures per month. As a result, I have a little extra cash every month so, I was thinking of saving and investing these money.

    My questions are:

    1. Am I allowed to save those extra money in a Cash ISA and start investing in Stocks and Shares?

    2. Are my creditors have the legal rights to know about my savings and asset in shares, thus, asking me to increase my monthly payment to them.

    Hi!

    To cut a long story short a PRE-BALIff card just with my partners name and a number to contact was posted to my partner ( with completely WRONG address details last week.

    It turns out it was due to a late payment we had arranged from a CCJ (because my partner was in an accident we forgot, silly i know!)
    This is what then happened..

    Since this, it turns out it was a card sent by a debt collecter stating pre-baliff visit and on SPEAKING to the lewis group asking kindly 3 times if it would be possible to reinstste our agreement, they refused flat until the £122 was paid, for the fees for the visit, we also spoke to the debt collector who also said it was for a visit she had made. Here is the good bit..
    There were NO VISIT the 'we called earlier PRE_BALIFF visit' card was POSTED in an envelope with postmark, stamp and everything, disgusting!!

    Also i believe that a debt collector has no right to charge fees? (as this is NOT a balifff)I believe this to be entrapment as no doubt without paying this, then the next step WOULD be a baliff visit?

    I still have the envelope, to prove this and in feel we were bullied into paying, when the £122 was meant to be towards our mortgage.

    Can i claim it back due to the entrapment as we did ask 3 times that we were willing to keep up payments but was NOT allowed to..

    Also the information and address of the card was totally incorrect, with NO reference number or anything but a number to call (the debt collectors)

    Should i write The Lewis group a letter of complaint or should i write to the court with the original ccj stating the visit was false and that they would not rearrange unless i paid the £122?

    I can't really use form N245 as it had not gone to a baliff.

    any advice please! this should be reportrd to the OFT!

    You will find that you will get quite a lot of letters threatening court action if your creditor is unhappy with your offer. Most of the letters that come through are just standard collection letters.

    The creditor may pass your debt to a third party debt collection agency. If they do this you will have another opportunity to negotiate your token payment.

    If the creditor applies for a CCJ you will still only end up paying what is affordable in your budget.

    Hi there,

    I spoke to a Halifax advisor today and they've told me I should contact PayPlan as this is the best company for my situation, which is.....I have 3 credit cards totalling a debt of £8000 and am beginning to struggle to make the payments.

    Is this correct, I don't see PayPlan as one of the options listed on this website therefore a bit unsure??

    I wrote just over a week ago to all the DCAs I owe money to asking them to stop action on my accounts while I sort out my budget and payplan however NCO Europe are continuing to telephone me 5+ times a day and have just sent a 72 hour notice letter to get things sorted despite me writing to them which has sent me into a panic. I'm trying to keep as calm as I can and deal with it all as the increased stress level makes me ill and I was wondering what the best next step is in dealing with these as they seem very heavy handed :( Thanks in advance

    Hi there,

    Santander has indicated that they will be exercising their right of offset between all of their banking groups. If you do not change your bank account you may find that they take money in your account that is meant to pay your priority bills.

    Is it really necessary – I would say yes, I know it is a pain, but you do not want to find your self without money for a full month if they take your wage as soon as it goes into the bank.

    Hi MRS A,

    When anyone does a budget it is difficult to say that your circumstances are not going to change. However, if you think that your circumstances may change for the worse in the near future, it may be worth putting off starting on a DMP till you know what is happening.

    If you go to Debt Remedy, you will find contact details for our support counsellors. I would recommend that you give them a call and discuss your options.

    Hi there,

    DMP’s are there to get you on with your debt free life as soon as possible. If you have extra money available at the end of the month, it would make sense to put this toward your debts so that you can pay them off quicker.

    If you are paying interest on your debts you are probably paying more than you would make in a savings account.

    Just think – when all your debts are paid off you can start saving with the money that is currently going to your DMP.
