If you have not put forward an offer of repayment one will be set by the court, if this amount is unaffordable you can apply for a redetermination.
I have sent you a PM with a sample letter that you could use or reword. I would recommend that you have an appointment with the CCCS so we can help you put together a detailed financial statement and make a suggestion on how much to offer.

19 years is a long time to be on a payments arrangement and taking into account your age and situation seems like once your wife retires things will only worsen. I would recommend that you have an appointment with the CCCS so we can discuss your options. If you have an asset then selling this to clear the debts is a good option but if you don’t want to sell, once your wife is 55 you could look and see if equity release is a possibility – The CCCS would be able to look into this for you. Im not quite sure I am in the right place, so feel free to redirect me to the right place.
Im asking on behalf of my daughter and family (partner and baby) who have got themselves into a right mess.
Evicted from their home (non payment of rent) they now live with us. They have now had letters from a debt collection company saying bailiffs will call if they do not settle unpaid council tax amounting to £5000 (I believe this goes back 5 years which we did not know). They don't own anything, everything in the house is ours, they have no work, only benefits, are unable to get housing benefit (which is why they live with us) and no money in the bank. They do not have any credit or store cards.
They have been to CAB who they felt were unhelpful but gave them information on bankruptcy and DROs as well as some other things Ive never heard of. We are finding the information confusing regarding a liability order.. I don't know what that means. Does it mean that even if they have a DRO or bankruptcy that the council tax bill would not be included? If this is the case how can they pay this huge bill with little income (they receive ESA and child tax credit/allowance) and no assets (they have only the baby's things and their clothes). They are extremelety worried that they will go to prison and their son will be taken into care. They both have long standing depression.
They want to sort it all out and make a fresh start but just dont know where to start and I feel pretty helpless at the minute. I am unable to pay off the debt for them.

As long as the Council Tax arrears are for previous years these would be included in Bankruptcy and DROs.
If your daughter and her partner would like an appointment with the CCCS, they can call our helpline free on 0800 138 1111. We would be able to help them complete a detailed budget and look into her options.

Information stays on your credit file for six years from the date of issue. I have attached a link to a booklet so you can read up about credit file.

Hi chinawhite and thank you for your message
Even though they are refusing your offer, you need to continue sending your token payments. You cannot give them money you do not have. Do not be pressured into paying more than you can afford.
If you have sent them a copy of your budget and a list showing any other creditors, then you have done everything you need to.
Token payments are not a long term solution to your debt situation and you need to look at ways to maximise your income or cut back on any non essentials in your budget, if you have not already done so.
If you can see no changes in your circumstances in the future, then you may need to look at other options.
I would recommend that you continue what you are doing at the moment, and if there are any changes to your circumstances, then contact us again so that we can review your options.

I spoke to a Halifax advisor today and they've told me I should contact PayPlan as this is the best company for my situation, which is.....I have 3 credit cards totalling a debt of £8000 and am beginning to struggle to make the payments.
Is this correct, I don't see PayPlan as one of the options listed on this website therefore a bit unsure??

We have been on a DMP for about 4 years now and are within 12 months of finishing. We have just recieved a letter from the CCCS advising us to change banks from A&L to someone else as we have a debt owing to Cahoot and they may reclaim it from our account. Is this really neccessary? Have they done this to other people?

I have a DMP with payplan I've only had it for a couple of months but up till now everything seems to be running fine and all of my creditors have accepted my payment offers except for next they have rejected but stil accept my payment, but as the amount outstanding is small I am going to try to pay this off in the next month, Pay Plan have been realy helpfull for me20p savers club 2013#23 83.00 (2014 numer 6,70.00 pounds) 2036SPC No 6(2013) 182.34
