    Will the fact that these searches are on my credit file affect my ability to get credit? I assume it may as my storecard limit was reduced dramatically without any missed payments etc. Also, will it affect my ability to get a mortgage? I'm waiting on a reply to the prove it letter and if I get it, will then send the letter for the statute barred. Can you also please advise if they are legally allowed to carry out a credit search and if so why?

    They will be just viewing your file not doing a full credit search; companies sometimes do this when they are trying to trace a client i.e. if someone has moved without giving their new address.

    Your store card credit limit will be nothing to do with this and you would need to ask them why they have reduced the limit, and the same goes for future mortgage applications.

    They would not legally be able to do a credit search on your file without your consent but they would be able to view your file which is what they have done. A credit search happens when you first take out credit – this is what they read out to you over the phone when you make an application.

    Hi all,

    Sorry if I'm being a nuisance but I don't have much time on here and thought it'd be best to ask the question than start hunting for similar questions!

    Just got my DMP from CCCS and they say I should start repaying £124 each month to my three creditors. This is fine but I'm not sure if this is taking into consideration the £100 each month that gets taken out of my bank on my pay day to cover my overdraft repayments ( which is currently £500 and should be cleared by October). I need to call and speak to them about this but the number says the DMP helpline is only open 9-5 and these are the hours I work and don't really want to be discussing all this with my colleagues overhearing! So my question is basically what other number should I call about this? Just the general CCCS one? A simple question I know and I feel daft asking but my head is all over the place at the moment and I can't seem to think straight!!!!:eek:

    Hello,

    Your overdraft will be treated the same as any other debt so will get a reduced payment through your plan.

    You will need to arrange for a new bank account to be opened away from anywhere where you have debts, this is to make sure that your money is safe. Once your new account is opened transfer your priority direct debits over and pay them as normal – this would be things like Council Tax, rent, water, gas etc

    As long as your overdraft is in your list of creditors, you would not need to do anything we will sort the rest out for you.

  • I am currently at the beginning of my DMP with CCCS I have a loan and credit card debt with HSBC, my son who is 2 has an account with HSBC with me named on it the title of the account is my name Re my sons name. Can HSBC take money from my sons account to cover my debts? I am a little confused about the rules

    Are would recommend that you change that as well, it’s not worth risking it if he has any money in his account.

  • Hi, briefly, i divorced several years ago and ended up in private rental which as anyone knows is very expensive. Subsequently, I have ended up with rather a lot of bad debt, i have £4500 on my credit card, which at the moment i am paying off at £100 per month, on a reduced plan with MBNA. I have a reducing overdraft with Nationwide, which is at the moment £800 and reducing by £60 per month and also have a overdraft with Barclays at £2.900. The o/d with them had been overlooked as i had moved house, and it was the interest each month that was inflated, as I hadnt got notification and didnt realise it was rising so rapidly each month. I complained and they dealt with my complaint, and now they are pestering me for the money. So much so that they passed the debt to RMA who are phoning me constantly and also threatening to turn up at the door. I have spoken with RMA and explained that I want to pay it off but |I cannot afford any more than £60 and that will put me with basically nothing left to live on, but they just keep saying not enough not enough. So so far have not come to an agreement, so worried about it I contact the cccs, who ran thru a budget plan with me and suggest that I have only £65 spare monthly to share between these creditors.They have sent me a DMP and suggest I act straight away. But i am worried about it, 1. If I tell MBNA they wont be getting the £100 they may get difficult. Also RMA for barclays I dont think will be satisfied. and i see from your paperwork that they can still keep pestering me for more. and even take me to court for more, even though i havent got it. Help, do i just beg steal but nor more borrow, to survive and continue making hefty payments and keep them away or do i choose the DMP.

    I just came off my CCCS plan after over 3 years. Still got a bit to go to be debt free, but with a couple of creditors starting to charge interest again I wanted the freedom to juggle and prioritize payments a bit. Don't want to breach the terms, so going it alone now.

    I've expressed it on this thread before, but I just want to express again my gratitude to CCCS for the support and help over the past 3 years. It drives me nuts when on this board you sometimes see people complaining about things to do with CCCS. It's a charity in place to help people like you and me get out of whatever bad situation we've found ourselves in financially. Sometimes people seem to want to blame anyone but themselves for their situation. I guess I'll just have to speak for myself when I say I got myself into debt starting my business, and CCCS helped me (almost) get out of it, while reducing the worry so I could get on with my work and life.

    when my situation allows there will certainly be a cheque heading your way to help you continue the good work you do.

    This afternoon I had a interview with the specialized debt people through Citizen Advice Bureau. They were really good and because of my circumstances I get legal aid and they are going to write to all my creditors on my behalf.

    First of all I have been advised to get a basic bank account with a non tied company to the ones I have my debts with as to not affect anything once they start writing to my creditors offering the little amount I can afford to pay. They are happy with me and the fact I am not yet in arrears with any of my creditors. Hopefully this should work in my favor as I am being pro active in trying to sort out my debts before I do struggle to pay them. I am due to go on maternity beginning of July so I am going to struggle with a hefty drop in my wages. I have been living from my overdraft for many months so hopefully will be able to finally start to getting my life on track and be able to provide my lil princess with a stable home and steady income.

    Sorry to have blabbed on a bit but I forgot to ask the councilor when I get a new bank account and change my mortgage and income over to this account do I stop the loan and credit card payments and wait for the aid worker to get in touch with the creditors on my behalf or do I continue paying the normal payments until she has contacted them - she says this could take a few weeks as I need to get back to her with account numbers and addresses etc.

    Any other advice you feel you could give me would be much appreciated too.

    I'm a bit confused, so have a question. We got a letter from 1st credit regarding DH's debt with Santander. They sent 2 letters in one day, and are giving instructions to pay them instead of Santander. We haven't received anything from Santander saying they sold the debt. Do we continue paying Santander until they tell us otherwise? Or do we now start paying 1st credit... How do we know - we've been bombarded with so much post from Santander that it's just ridiculous, but never anything saying "ok pay 1st credit now as we've sold the debt to them"

    Hi there,

    I have managed to incur over about £16,000 worth of debt following the break up of my marriage. This is all due to having to find an alternative place to live and increased commuting costs. But was mainly triggered by the bank bouncing direct debits, the the charges and fine payments spiraling out of control.

    I have a few questions that are troubling me that hopefully I can get answers to from here.

    At least £6000 of the debt was is from joint credit cards (card in my name but the ex wife had a card of her own on the same account).

    Can this debt be shared with her? i.e. I only pay half ????

    If so what would be the best option to pay back the remaining 10k. ????

    I am now in a happy relationship with a new lady and we are thinking of maybe getting married in the future. She is a home owner with quite a bit of equity in her home.

    Would my debt issues cause her any problems if we did get married ? i.e. could the companies I owe go after her ????

    I have not long started a new job after about 8 months out of work and wish to get back on track and pay off my debts. Where is the best place to start. ????
