    You need to continue paying the DCA what you can realistically afford.
    Do not be pressured into paying amounts you do not have.

    Collection agencies still have to follow Office of Fair Trading (OFT) guidelines on fair debt collection. They should not make threats that are untrue.

    The DCA will also need an up to date copy of your income and expenditure. They don’t always ask for proof of income, but it may back up your offer if you did supply evidence of income.

  • Hi Sue and Pavan. I have a couple of queries:

    1) We've paid our first installment to CCCS and the letter has gone out to creditors. We've had letters back from just 2 of the 20 and they have both said they will only accept the plan if we also pay an additional amount every month directly to them that they will identify. I've ignored these letters so far - is there anything I should be doing?

    2) I changed our bank account and notified the housing benefit payment department of this, using their change of circs forms, giving them two weeks notice. However, despite phone calls etc they deny having had this information and have managed to pay two installments (one per fortnight) into my old bank account. This is now 'enquiry only service' so I can't get to the payments (it is in the overdraft although not over the overdraft limit). Is there any way I can get the bank to hand this over?!

    3) Related to above we are now down by £244 in the past month which is financially crippling but we've only just made the first CCCS payment - is there anything we can/should be doing about this in terms of the DMP and CCCS?

    Hi Sickasachip13 and thank you for your post.

    Firstly, I wouldn’t recommend that you pay extra money to your creditors directly. We will have already worked out your income and expenditure with you and you would have to sacrifice one of your essential living costs to be able to pay them more. Your creditors will have received a copy of your budget, so you could write to them and explain that this proves that you can’t afford anymore than you’re already offering.

    With regards to your Housing Benefit, I would recommend that you contact your bank either in writing or in person to explain your situation. There is no guarantee that they will release the money, but as it is a state benefit which is supposed to pay for your rent, hopefully they will.

    Lastly, I’d recommend that you call our client support team to discuss what’s happened. If you’re struggling because of the housing benefit mix up, they may be able to vary your payments to allow you to catch up.

    Hi jasperconran and thank you for your post.

    Your DMP start date should have been on your paperwork that was sent to you after you spoke to one of our counsellors. It’s likely that if your appointment was on the 29th of November, this would have been too late for a December start and it should be on track for January.

    If you would like, you can send us your client reference number (in a private message) and I can forward it to the relevant department who will contact you to give you an accurate update. Alternatively, you could call our client support team who will be able to tell you straight away over the phone.

    We have applied for redetermination of a CCJ.

    We received a reply from Northampton CC saying this would be passed to our local CC.

    Our worry is that the date that Northampton said our payment was due was 10th December and we haven't heard from our local court yet...is this normal or should we chase it up?

    Hi there , Just a brief run down of my financial STATE lol dont know why im laughing cos it aint funny just STATE being the obvious word , Anyway here goes after years of living the "Good life" ive now totalled up debt of £4500 through catalogues, credit cards, 2 payday loans, and its finally come to a head and after reading up on this site ive applied to CCCS online for help and they/you have came back with a debt remedy plan for me £100 pm (in about 15 mins) which would be fantastic although its not in concrete yet recieved an email from CCCS asking for account number for one of the catalogue statements i didnt send off as the balance was zero, also i said that my Gf was offering to help pay my payday loans off so didnt include the account numbers either and CCCS said they could not start the plan until they knew if it was payed off yet or not in hindsight i may be jeopeordising (how the hell do you spell that Jeopoa oh i give up ! ) the DMP and to be fair why should my Gf have to pay for my living like a king, i have now emailed back with all these account numbers and also asked for advice what would be the best option on these payday loans so i can get this set up asap Ive ruined my credit file for a good long while now and tbh i do not want any more credit for as long as i live Im 28yo man with a good job and would class myself as intelligent yet so stupid and im too young for all this to be happening (endless phone calls rainforests lost due to my post on a daily basis ) ive just been diagnosed with Trigeminal neuralgia and its made me get my life sorted and take action to at least try and help ease these head pains slightly anyway off on a tangeant there my question is - Have i Jeoperreredised (lol)my DMP in anyway by saying i might be getting these payed off by somebody else because i emailed straight back with details of account numbers and to include the payday loans if CCCS feel fit- i really hope not:(- Also ive read quite alot of good stories about CCCS and most creditors agree to there proposals does anyone feel there will be an issue with these Littlewoods Very Empire Choice Great universal Kays Additions Jacamo JD williams Vanquis Capital one Uncle buck ( ive read about these and not good ) Pounds to pocket

    I’d recommend that you contact your local county court to see if they have received your paperwork yet.

    Hi Gstar2 and thank you for your post.

    You won’t be jeopardising (that’s how you spell it!) your DMP as long as you are honest with your figures. It is up to you what you decide to do, but if your girlfriend isn’t going to pay your loans, it’s important that you give us the details of all your outstanding debts. This would ensure that you’re not showing some creditors preferential treatment over others.

    On the other hand, if your girlfriend is going to pay off some of your debts, I’d advise that she does this before the start of your DMP.

    With regards to how your creditors will react to your proposals, it’s really difficult to say. You might find other forum users have past experience with these particular creditors, but we have found that they can differ from one person to the next.
