    I have recently started the process of buying a shared ownership property with a housing association in the south of Englan.

    I have been fully approved by the HO and need an agreement in principle.
    I went to see a good friend of mine who is a mortgage broker and went through all the preliminaries only to be declined?!

    I searched my Experian and Equifax credit file and have found a CCJ which was registered in Sept 2009 against my name but heres the interesting part.

    I used to be the secretary of a Sunday football league team and they booked some training facilities to train on. One thing led to another and they didnt use the training facilities over a cold snap and then didn't pay the bill (£281.00). I recieved court papers which began the proceedings of a CCJ against me and I returned them to the court with a note on there that I am the secretary of the club and I filled out the statement of means based on the clubs income.

    I then left the club and decided not to run as secretary anymore but the 'new' secretary told me that he would continue to pay the installments which were set up. I now see that these haven't been paid and the CCJ has been enforced against my name.

    I have only just discovered this on my credit file - is there a way I can get this set aside as the club is no longer running and I know for a fact that the 'new' secretary wouldn't take a CCJ in his name (who would!).

    I'm happy as the club closed down with a balance of £414.00 (Ive been told) and the old treasurer is happy to clear the outstanding balance either to the court or the training facility.

    Any help is appreciated? Not sure if this is the right place to post either? Its my first post so please be kind!

    There are three main credit reference agencies, Experian,Equifax and Call credit. If there were any CCJs outstanding, they would normally show on your credit file as they remain on your file for six years.
    This booklet called ‘Credit Explained’ has addresses of all the reference agencies.

    You could also check the Registry Trust for any CCJs you may have registered against you.

    There is a charge for this.

    There may be other reasons why you are not able to get any credit. Even people with good credit history do get turned down for credit

    Great to hear you have taken the first steps to dealing with your debt situation :)

    If you are administering the debts yourself, then you would need to contact your creditors with offers of payment. You can quote your client reference number with CCCS and explain you have received advice from us and show them a copy of your budget.
    If you are waiting to set up a DMP with us, then you can refer the creditors back to us, as we will be negotiating the payments on your behalf.

    The creditors could look at issuing a CCJ.
    You would receive a claim form with a county court stamp on it which is sent through the post. You would need to fill it in and return it with a copy of your budget and a realistic offer of payment. You would not normally have to go to court. This would then show on your credit file for six years.
    If you do receive a CCJ, then call us for further help and advice on what to do. It is important that you respond to it straight away with an offer of payment.

    Hi there,
    I have had an appointment with a debt case worker at CAB to sort out my catologue/credit card/over draft debts of £4000. because of my situation, they have put me through for a debt relief order.

    As i am currently paying minimum payments on all of the creditors but the catologues,he has advised me to stop paying all creditors. the only things i am to pay while the debt relief order is being processed is gas,electric,water,rent and tv licence.
    He ordered me to go straight to my bank and cancel any direct debit to companys as he said that they will get funny at the fact that i am paying some and not others.

    Is this right advice???
    I have been told to answer the phone to creditors and say that i am in the process of some help from CAB and have been advised not to pay you... but they are not taking it very well!

    Also as he said that I am only to pay gas,electric,water,rent and tv licence.. i have virgin media and an orange contract.. am i not to pay them too? i need some sort of way of contacting family.

    I am sure that the CAB would have given you the right advice with regard to what you need to do whilst waiting for your DRO to be set up.
    As they have said, you do need to make sure that all your priorities are kept up to date.
    So it is important to make sure you can afford to pay your rent, electric, water, council tax and TV licence etc.
    Without knowing your full financial circumstances, I am not able to advise on whether you would have enough in your budget for things like Virgin Media and a mobile phone contract. There is usually provision in your budget for some phone costs.
    If the DRO is going to take some time to set up, then you could offer the creditors a £1 token payment as a goodwill gesture. But again, this would depend on your ability to offer this if you have nothing left over after paying your priorities and you are saving for the DRO fee.

    If you have any concerns regarding phone costs, or dealing with your creditors whilst waiting for your DRO to be set up, then I would recommend that you contact your CAB adviser for further advice.

    I have about 28k worth of debts between 7 different creditors - those were being paid at £570 per month through a DMP with CCCS.

    From today I am out of work and will be getting a bit of money which I would like to use to possibly make an offer to the creditors for a reduced final settlement of the debts, to have them all completely written off/cleared for a reduced amount of one off payment.

    As I have no idea how long will I be out of work (nobody can ever plan for that) and I am not able to make the £570 per month repayments, is this something that you feel may be accepted by my creditors?

    From your experience, what percentage of the original debt would be the lowest that they are likely to accept?

    I have seen figures between 20% and 60%. I think I could probably make the 20-25% offer - is it likely to be accepted or not?

    Not sure if this matters but the debts are (rough figures) with:

    Abbey National Plc 7010
    MbNA Europe bank Limited 6400
    Credit Security Ltd 6050
    Robinson Way Ltd 3050
    The Littlewoods Org 3500
    Abbey National plc 1500
    Santander Cards 300

    I would recommend that you contact our client support counsellors for further help and advice regarding your lump sum. They will discuss all your options with you and if a full and final settlement is possible, will help you to work out amounts to pay to each of your creditor. If the lump sum you are receiving is redundancy money, you need to make sure you will have enough to live on until you get another job.
    If you do make an offer to pay off the debt you need to get it in writing from your creditors that they will accept any offer you make in full and final settlement of the debt before you part with any money. You also need to ask them to mark your credit file as fully satisfied.
    Otherwise, if it is marked partially satisfied, there is a chance they could contact you in the future for repayment of the remainder of the debt.

    Your counsellor will be able to give you more information regarding this.

    Im coming upto 12 months since my LBM and all creditors have excepted my debt management plan (self managed through CASH flow) except Capital One I complained to the FOS who said Capital One were in the right because I did not send them proof of income benefits etc but I thought I only had to provide my SOA and offer letter Im so confused by everyones responses can you shed any light they have sold me onto a DCA who are now threatening all sorts so I would like to know where i stand and if I can do anything I am still paying my pro rata offer and have had no problems with my other creditors please help
  • Hi had a loan 4 years ago which i cleared when i moved home,the loan had ppi which i had to take with the loan. I recently contacted the company who sold me the loan asking for the contract of ppi but they told me they had nothing to do with the ppi and the company that sold me the insurance was no longer in buisness. Is there anything else i can do.
