Offer made with original agent.

A friend of mine made an offer with Agent A last December on a property priced 430k for 350k It needs loads of work and agent A said it was on for too much. Offer was refused, then taken off the market.
Now...this property has just come back on the market for 359k with agent B. My friend is still keen but told to deal with agent A even though its not marketed by them. the problem is that the vendor is refusing to deal with agent A due to finding out the property had been overvalued and their aspirations were set on this.
Where does my friend stand? they still want to pursue it but Agent A insists they are their client and vendor won't deal with them.
Advice would be of help thanks

    Maybe I'm missing something, but can your friend not give Agent B the offer and they can pass it on to the vendor?

    Is it me?...Who told yr friend to deal with Agent A?

    Why would you want to offer on a house thru an agent who isn't marketing it?
  • Sorry the usual problem is that normally as a vendor who signs a contract with an agent they stipulate that commision is payable if their introduction results in a sale. I gather agent A would chase the commision as my friend initially made an offer through them. Agent B does not want to get involved as they would be doing the work and getting nothing for it. Hope this helps.

    Agent A will be claiming the commission as the he was the agent who introduced your friend.

    Agent B won't get any commission so won't deal with your friend.

    ETA: can't type as fast as lellow lorry.:(:D
  • Cheers LandyAndy, thats the problem and the seller will not deal with Agent A, I guess on the basis of the the original valuation and detrmined not to let them get any commision because of this. This is harsh on my friends who seem stuck in between.

    Agent A will still get paid on this if the friends bid is successful due to them introducing the property to them.

    Agent B will not deal with them knowing that Agent A made the introduction and they will not get any commission.

    I would try and deal direct with the Vendor, but they may refuse to deal with your friend as they dont want to line the pockets of Agent A and may be liable to paying two fees (although Agent B's reluctance to get involved would indicated they dont expect a fee if your friend buys the property).

    If Agent A is willing to forego their commission then your friend may be able to get a deal going, but wheres the incentive for Agent A to do this? Where is the incentive for Agent B to deal with your friend if they wont get paid for it?

  • betbunch...not them but Mann & Co, they are a national agent so their contract will probably be watertight. Agent B is a local indendent so will not want to get into any litigation I guess.

    Agents and commission are all the seller's problem. I would approach the seller, saying what the problem is. Best troute would probably be for selelr to ask Agent A to approach <friend> who offered in December.

    Obviously Agent B are not going to cooperate in this.

  • i will pass this on. Its about all they can do.or approach them direct. The seller is determined not to line agent A pockets but seems crazy if it if it sells.
