Sect 75 refund - Not as straightforward as I thought

Im a Cartel customer and am presently trying to recover my £990 Cartel fee using Section 75 on my Halifax Credit Card which I thought would be straightforward. I contacted Halfax using the Section 75 template available on MSE, sent them a copy of BBC news report relating to Cartel being closed down and copy of letter concerning CCLS being shut. Halifax replied to my letter requesting Cartel Terms and Conditions etc and proof of invoice, what attempts I have made to contact Cartel etc. I never received an invoice from Cartel. The Cartel representative swipped my Credit Card they gave me the standard credit card transaction slip. Evidence of the transaction is on my Halifax Credit Card Statement. In my first letter to Halifax Card Services I outlined all my actions. The letter they have sent me more or less asks me for information I had already given them! Im beginning to get worried that Halifax are trying to avoid reimbursing me. I have responded to Halifax reminding them that the Cartel cannot be contacted as they have been closed down. Any advice appreciated.

    I suppose the logic in asking for the T+Cs is that they need to know what you were promised in order to determine the extent to which you failed to receive what you were promised.

    It might be a fob off/delaying tactic, but I think it is reasonable for them to ask.

    If you don't have any T+Cs, send them any other material you have from them or write down what you were promised for your money. This will be the contract against which your s75 claim is based.

    I don't know anything much about the Cartel thing - perhaps someone else can help more.

    Just need to add that I became involved with Cartel Client Review Ltd in Jan/Feb 2009. Will the Credit Card company try to wriggle out of it due to time lapse? Im getting worried about chances of getting my money back. Im sending Halifax Card Services Cartel's Terms and Conditions.

    So what had they done for you since that time? Had they performed services? What hadn't they provided that the contract said they would?

    Isn't it ironic OP... you contacted Cartel to get your credit card debt wiped, but when it all goes belly up for you, you run back to the credit card company with your tail between your legs asking them to help you?

    It aint a Section 75 reclaim.

    The bank are simply charging back the transactions back to the merchants bank- Believe its Natwest.

    As it was mostly an ongoing service or expected to be recieved with 6 months.

    Bank need all your documents/description of the service you paid for. All your contact with the merchant.

    These templates online are utter garbage.If people actually contacted their bank they would "usually" get told what information is required.

    It aint about the bank getting out of anything, bank isnt loosing anything as its not getting paid out under section 75. Money is pulled back from Cartel clients bank...

    ElkyElky Im with you on your post- I think its ridiculous people have to be helped when they have been trying to get out of their credit agreement with the same bank they are then again asking for help from.

    But there we go thats just my view. All the best geordiegem you will get it sorted ok.

    Just for the record my claim through Cartel wasnt against the Halifax

    s75 and chargeback aren't mutually exclusive. s75 makes the bank jointly liable with the merchant for provision. It defines a relationship between the credit card company and the consumer.

    Chargeback is merely a mechanism by which the credit card company attempts to recover the money from the merchant.

    Actually I find it even more ironic that Cartel were provided with credit card facilities!

    Hi ,

    I got caught up in this Cartel and also got told that i could claim the money back.

    I have no invoices but i do have the statements with the transactions.
    I have no terms and conditions as these were not issued.
    I am unable to corrispond with the merchant as it has ceased to trade.

    How will i possably make a claim?

    Any advice appreciated.
