  • Ok, let's firstly go back to the start. When did you instruct NatWest NOT to change your account to a fee paying one, and I assume you mean one with "extras" ie advantage gold or advantage blue?

    I got in touch as soon as I found out.

    Ooooh, you have now got me very very very very intrigued now.....hands are rubbing with glee. When you spotted this AGAIN ie the charges, did you complain again?

    I was paying interest on the charges, an unauthorised overdraft, and more for letters to tell me I was exceeding my O/D. Sort of 'you are o/d by £xxx, here is a letter costing £25 to tell you. Oh by the way you are now o/d by £xxx+25.
    If they had frozen the account as requested by CAB when they sent my Financial Statement and offer to pay forms the first time I would have been able to make inroads into the debt.

    Instead they refused, lost the next set of paperwork, took over 8 weeks to even look at the 3rd set and froze the account 18 months after being asked to, when the debt from the charges and interest were treble what the debt I had run up was ( and most of that was interest, fees and charges, not what I had gone out and bought things with).
    Did they lose paperwork from Citizen's Adive?
    In effect I was paying interest each month on interest they had charged on fees that they had imposed that they were not supposed to have put in place in the first place.
    Let's try and work this from the first point.
    I am looking at the advantage gold stuff first cos I suspect the branch went on that 90 day money back nonsense and yet failed to actually look at whether you actually needed the account. If the fees did lead to unarranged borrowing then we are looking at the consequential losses that came about because of the failure to administer your account correctly.
    With regards to DD's and Standing Orders we will see what can be done in this regards as to whether the fact there was no refunds on the above may have indirectly lead to further charges. They may not have dealt with your case properly or even considered you being in financial hardship even though you had numerous charges on the account which might have outweighed the income coming in.
    I think we have a chance on this one.

  • You did because you accepted their offer twice in writing and NatWest would have a record of offers being made. Furthermore, the Supreme Court Judgement did contain elements which did state that individual claims would be successful against the collective challenge made by the OFT.
