Toshiba Laptop same fault 3 times since purchase Dixons Online

Hi all,

Wonder if anyone can help or if any one has had the same problem.

I purchased a Toshiba Laptop from Dixons online in July 2009.

In October it started shutting down unexpectidly with no warning.
They collected and repaired.

In January 2010 The same problem started (shutting down all of a sudden with no warning)
They collected and repaired ( creating inconvinience for me as i need the laptop as I run my small business from home and need it to access the net)

March 2010 Again!!! its doing the same thing shutting down - when i phoned up this time to report the fault I asked what exactlt was wrong with the laptop the last 2 occasions when collected and apparently repaired, I was told the fan was broken, I find it hard to believe that the fan would break every 2 to 3 months constantly.

Now since purchasing the machine on July 09 its has broken down on 3 seperate occasions with in 8 months of purchase and each time i am left with out a laptop for a number of weeks.
I have really had enough and they have collected for repair, I have told them this is not acceptable, this isnt what i paid for and I not willing to have to keep going through the same scenario over and over again.

Please could some one tell me what are my possible rights regarding this after the 3rd time of fault developing?

Really appreciate any feedback.

Thankyou.

(Please excuse any typo's)

I would write to head office and ask for a more acceptable solution- I am not sure what your rights are but I'm sure someone on here will know.
I have an Advent laptop that does the same thing (most days). Sometimes it turns off even when it is cold and hasn't been on for long. Unfortunately mine is a little older but it is a common problem with this particular model. Maybe they use the same parts?

Under the Sale of Goods Act you are entitled to a repair, replacement or refund. The remedy chosen can depend on which is the most economical for the retailer. However there is a big caveat, no remedy should cause a "significant inconvenience" and although that's open to interpretation I think you have strong case to argue that any further repairs will constitute such a significant inconvenience. Refuse any more repairs and demand a replacement.
  • hiya, this might sound like a daft question, but are you still using the original power lead and charger that came with it?

Hia, Yes!! useing all original power leads / charger ect and also at times when its suddenly shut down it had only been switched on for litteraly 5 minutes so cant be connected to only when overheating.

Hi, I dont have a lot of time here atm but just quickly does the problem occur when you have been switching between battery and the power adaptor?

I had a massive problem with Evesham 2 years back and eventually pin pointed the issue myself.

Ill check back tomorrow, may be pm me if needs be.

It should still be under the manufactures guarantee,

Stop with taking it back to the shop, your not really getting anywhere there.

The OH works for Dell as an engineer (so just asked him what you should do)
you will get a better response, an engineer to the registered address at a convenient time IF you have call out warranty (check your warranty)
if no call out warranty it will be sent back to manufacturer.

He no longer wants a repair, this is the whole point. He's after a replacement or possible refund, something the manufacturer is unlikely to offer.

On all 3 occasions I phoned the appropriate number on the dixons website and they arranged for the laptop to be collected and repaird, on all 3 occasions its the same fault. The laptop was purchased in July 09 so its still under 1 year since purchase.

Hi, got your pm. Write to the head office (recorded delivery) as suggested and explain everything to them in detail, try to add all dates and names.

Let us know how you get on.
