Help Needed!!!

I bought a mobile phone from ebay 2 weeks ago payed by Cheque £185. seller has cashed the cheque and no phone sent he said he has sent it but obviously not.Now he is saying ebay has informed him that some one has tampered his account which again he is lying and is saying to be patient. I am not the only one he has sold to he has sold 10 mobile phone at the value of £1549.00 and other buyers are contacting me and others to see if i have recieved the phone as they are also having problems. Can some one tell me what can be done about this???

    I'm guessing that you are covered by eBay's Standard Purchase protection? However the maximum amount of coverage under the SPP is £120.00. There is also a £15.00 processing charge, leaving just £105.00.

    Firstly you will have to file a claim for goods not received and then in 5 days time file a claim under the Standard Protection Policy.

    I would do as the previous poster suggests and start a dispute with ebay.

    I have started now only paying by paypal - then I can fall back on either them or the credit card company if anything goes wrong - and not get £15 taken off it.

    Whats the sellers previous feedback like?

    sellers previous feedback is only 10 & 100%. i had no choice but to pay by cheque as his paypal account was not correct.
  • possible fraud - if u believe that this may be a fraud then report it to your local police to carry out enquiry. You will obviously have all the sellers details as you sent them a cheque so you can pass these on and they will forward it to the police force that covers them to deal with it. good luck.

    Oh dear, this sounds like a real scam, the old 'advertise paypal but then find you can't use it after auction ends' trick. I can only concur with what the other posts have already said, your only chance, and that is not guaranteed, is to go for an ebay claim and recover part of your money.

    You could , as has been suggested, contact the other sellers and inform the police, who won't be interested but it is worth a try. Unfortunately a 'good' scammer will be using an address that can't be linked back to him so the chances of you meeting him even if you pitch up at the door is remote. Th emost common ruse, at least in Greater london, is to use a multi let property where there is no one living with the same name as the payee on the cheque, that leaves the trail absolutely stone cold.

    As a warning to others please watch for this scam. If a seller takes paypal and then can't accept it at auction ends, move on. A genuine seller will be happy to wait until they get their paypal account sorted so you can pay properly, only a scammer will try and force you to pay by cheque or some other insecure means.

    I heard recently that the police are taking more of an interest in ebay scams... at least, online crimes.
    My TV is broken! :cry:
    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    But if the cheque has been cashed won't the bank be able to find out what account it went into and who owns that account ?

    i had this happen to me a few years ago ...at christmas too childrens toys. a few other people got in contact we all contacted this persons local police station all gave statements over the phone they were typed up sent to us for signing then the lady in question was arrested she ended up only being cautioned ..i didnt get my money back but .......now i always pay by paypal

    Data protection would not allow them to release that information without a court order, and even then it would be difficult.
