URGENT FRAUD HELP NEEDED (Please) !!

Ok first thing first.
Deal with the 2 major and urgent issues. 1) Your mother fraudulently applying for loans. Do not discuss it with her or listen to her excuses. Report to express finance that this loan was not taken out by her, and ask them to deal as such. If its a genuine mistake they will confirm this and resolve it. If it isnt ask that they take action to cancel the £400 loan and treat it as fraudulent. The fact that it is her mother does mean she will likely need to prosecute her for this though or take the hit. The bank/finance company wont let her have it both ways and take the loan off but not treat it as a criminal act
2) Deal with the bank problem. Phone the bank and tell them that the account details are compromised and ask that all security information be changed and flags added to the account to indicate problems and higher security requirements
Finally contact CIFAS who will put security flags on which will prevent additional problems although the banks will probably do this anyway.0 -
Have spoken to a fraud investigator in local force.
The victim here is express finance. My GF is purely a WITNESS to a fraud by false representation. The decision to take the matter to the police is in the hands of the financial institution, as they are the victim... so will have to see what express finance wish to do!0 -

What your GF needs to ensure is that she does not get a CIFAS marker (as opposed to a preventative flag) on her credit record. This would be placed if the company believe she has colluded with her mother in any way to falsely obtain credit.
So get that preventative flag up there ASAP.If you've have not made a mistake, you've made nothing0 -
You could also ask the bank to issue her with a new account number, since this one has been compromised. It is apparent that the mother has access to the bank details, so they must be changes to prevent this happening again.
Does your GF have access to her mother's property? Personally, I'd pop over and remove all goods I could lay my hands on as recoverable assets, until the mother provides sufficient money to settle the loan in full. That's just me though. I know it's illegal in some ways, but so is fraudently obtaining money......
Your GF could also put a note on all her credit reports pointing out that a specific individual has targeted her for identity theft, and therefore all applications should be verified in person with valid ID. It probably won't stop her applying, but you may reduce your liability if she sneaks something else though.

Hello all,
An update.
Spoke with Express Finance this morning. They confirmed that the loan was taken out electronically and signed as such... and not through a broker.
We also reported this to the police as a crime related incident, just to cover the GF even more.
We then took out a protective registration through CIFAS.
We emailed Experian and asked that they password her credit file.
We need to phone Halifax and get them to issue her a new account number so that her mother doesn't have access to it anymore.
She phoned her mum and all she said was "I'll transfer you the money back when I get paid" - which is the closest to an admission as I think we'll get.
We then texted her and said "Express finance need your debit card details so they can take the money from your account as I'm not liable" which is what the fraud lady asked for on the phone.
...And thats where we are at the moment...0 -
i'm not trying to be devils advocate , but are you sure its not just your girlfriend making this up ? are you sure its not her that has actually got the loan , or does she owe her mum some money , has her mother got any special secrets shes knows about your g.f ? look at all angles , especially if it might be you that is going to be the good guy and pay it for her / them......the above comments are just to hope all angles have been thought through ,as the apple often does not fall far from the tree .!!!!! justwondering - I appreciate you are trying to cover all bases but your last comment was out of order really. Guy has asked for help, and has been brilliant supported and given very accurate information on how to deal with it. Any other 'issues' will be investigated by the police now.

Given that I read the email from her mum where her mum says "I got a loan out..." and the fact that she is being investigated by another force for a fraud, and has done things like this before, I am quite sure.
My GF despises her mother for what she has done to her - in this case, the apple has grown wings and gotten itself as far away from the tree as possible.
Given what I do for a living, she (and I) both have to be whiter than white.0 -
