unadopted road what are my rights

Options
I have lived in my current house for 5 years. The road is unadaopted and I have to park my car on the street. Legally when we bought the house we were told that we (my husband and I) are responsible for the street and part of the road outside pur house. Recently the number of cars parked on the street is increasing. People who don't live on the street are parking there and someone who has moved in has a huge transit van and is starting to park it outside my house. I have a small 3 month old baby and need to be able to park outside my house and at the moment I am having to park on the main road! Also when I was heavily pregnant I had to park a few streets away and walk in pitch black to my home and I don't live in the safect of areas!

I would like to know what my rights are as I own the road outside my house and I only have a small car. I have put a sign on my house to politely ask for a small space to be left but I am getting so angry I want to know what to do next as no-one seems to take any notice and they are as good as parking in my driveway!

Thanks for reading this ramble but I need to take action it's getting to the point where I don't use my car!

Have you thought of buying a wheel clamp?

    You could make a fortune!

This is quite a complex issue.

Although the OP may own the land up to the middle of the road, it may not mean that she has exclusive rights to park their, or that other neighbours don't have the right to park opposite other homes in the street.

She would have no right to clamp either

Check the property deeds, and it may meaning getting specialist legal advice if this is a major issue.

Presumably the conveyance Solicitor warned you about the joys of unadopted roads when you purchased the place? Or probably not.

If there is a garden frontage, then having a dropped kerb built and forming a psuedo-access to the garden (ie one that you wont really use) will mean that anyone parking across the dropped kerb will be causing an obstruction which can be dealt with by the Police

It seems extremely strange that you would "own" the piece of road outside your house. Roads are normally the responsibility of the builder for a period of time after all building work is completed. They then have to ensure the roads are up to local authority standard where they will then become adopted. I've never heard of a house owner owning a piece of road unless it's a private road that is included in the title deeds of the property, but these would usually be an unmade track type road to a single dwelling. If it is more than one house you would usually have to pay into a management fund whereby the entire road is maintained and paid for by all parties but you don't "own" the road.
Personally if parking was such a big deal to me I wouldn't buy a property that didn't have allocated parking, it just causes way too many arguments.
