Returning a product for an exchange and being told to pay more

Hi,

I purchased a PS3 in Sept last year and it has developed a problem and i am going to return to the retailer. I have already spoken to them and they are fine with this.

My issue is that it was a 120Gb slim i brought and although they are willing to exchange they have not been able to order any from Sony since before christmas. i would therefore have to have the 250Gb and pay extra.

I would rather exchange like for like as i have no need of extra space.

My question is are they within there rights to charge me for the next model up because thats the only one they can give me.

    They are within their rights to offer it as an option, but you have the right to refuse and to be put back into the position you were in before you bought. Note that your right here is not to refuse an exchange but to refuse an upgrade at your expense.

    How much did you pay for the 120GB and how much extra do they want from you?

    They could send it away for repair and leave you without it for weeks, because a PS3 isn't an essential household item which you cannot survive without (No, really, it isn't!!).

    Otherwise they can refund you the price you paid, leaving you with a load of PS3 games you can't play. They don't have to buy those back off you.

    Also, bear in mind if a suitable replacement is unavailable or disproportionately expensive then they do have the option of repair or partial refund based on the amount of usage you've had of the item.
  • i paid about £250 for it.

    It will cost about £20 more to get the 250Gb but thats not the point i am happy with the one i have and dont need the extra Gigs.

    i will pay it though if i dont have a choice.

    They have offered me a refund or exchange so i was thinking of asking them if its £20 to get the 250Gb that would take it to £270 as they said, would i be able to pay an extra £10 and get the bundled games included. Longshot i know but i think its worth a try.

    If they've offered a full refund then take it and stop being so tight. You've had a good 6 months use out of your PS3 and you're lucky you're getting a full refund rather than a partial one which they are fully entitled to provide.

    As i have already said if i have to pay it i will its nothing to do with being tight and at no point did i mention i didnt want to pay the extra i just wanted to know could if they could do that.

    i also said i dont need the extra space so why should i pay for it.

    Also since when is it ok for a product to last 6mths. its not is it. fool

    I never said it was, maybe you should read my posts a bit closer. I said they could have offered a partial refund, nvertheless you've been lucky to get a full refund yet you're still not satisfied and moan over £20 because they don't want to give you an upgraded machine for nothing. If you thought that's what you're entitled to then I'm afraid it's you who are the fool.

    sorry i meant you were a fool in general.

    cant you get it through your thick head im not moaning about paying £20 extra i quite happily will. the point is i didnt want to upgrade i want the same one i already have.

    either way i get a new machine from either sony or game makes no difference to me. all i wanted to know was were retailers allowed make you pay extra for the next model up if they have none of the model you brought.

    all you did was state i was being tight, but if you read my post money wasn't an issue so therefore you are the fool

    I can't believe you're moaning over £20 for a new machine - also think of the extra 130 gigs that you get, bound to be of endless use.

    Looking at the thread, money isn't the issue to the OP - I think s/he was even looking at spending more money on a bundle.
