2nd Washing Machine in 12 months faulty.Can i get my money back

Hi fellow moneysavers ,
We bought a washing machine in March 2009.It started getting very noisy that summer .
Reported it and had the whole drum replaced as the bearings had failed.
Engineer failed to secure the drum properly, leading to more noise, and after much argument involving the supplier and the manufacturer, we received a new machine in December from the manufacturer themselves.
Result !
er NO !!!
Its now April 2010 and the same deafening noise has developed over the last month. Im 200% sure the bearings have gone.
My questions are :
Who do i deal with now with as the manufacturer supplied the replacement not the supplier ?
Can we ask for our money back as i dont wish to receive either a repair or a new machine ? I have no faith in this model
Can i refuse a repair ?
Can i name the suppliers and manufacturers on here ?
Can i afford all the phonecalls and the time off work like last time ??Can i charge them ?
Seriously though ,Which? recommended this machine at the time but now looking on their reviews for this model one guy ,a supplier, says that three of his customers have had the same bearings problem.One reports of broken down after 13 months.Many on revoo report of extremely noisy (wonder how they got on 6 months later )A model of similar number has some terrible reviews regarding bearing failure
So it cant just be down to us using it incorrectly surely .
If this was bought from a high street retailer it would be taken there and stuck under the managers nose until its sorted. As its bought online you have to have a bit more patience.

If the retailer knows you have had a replacement machine they would be well within their rights to say that it is not their problem anymore as you didn't come to them in the first place and you know do not have the original machine, if they don't know you could go down the sale of goods act but as it is over 6 months since you bought the washing machine you would have to prove there was inherent fault with it if required.
They do not have to give you a refund but can either repair or replace or refund (whichever they wish to do).
Personally I would be talking to the manufacturer now and looking for a compromise (ie paying the differance for a better machine)Always ask ACAS0 -

We did report initially to the supplier after the botched repair. They then got the manufacturer involved.
The manufacturer arranged a new machine to be delivered direct from manufacturer.
I feel our contracts still with the supplier as they got the money and they have sold us a machine unfit for the purpose it was designed to do.
They ,the supplier ,got the manufacturer involved as at the time we argued with the supplier "just send us a replacement from your stock" Not sure how it ended up being delivered from the manufacturer
"ie paying the differance for a better machine" I understand what you're saying but with the experience of their machine i'd rather have another brand and to have to pay more just wouldn't seem fair

Ah well now you said you went through the retailer then it is still their responsibility. If it is under 6 months since the replacement I would have thought that it is down to them to prove that the replacement was not faulty inherently but if it was after 6 months then the responsibility lies on you.
However whatever happens they don't have to give you a refund, but can repair or replace. I would still offer to pay for a better one and ask to pay for the differanceAlways ask ACAS0 -
just my two-pennorth here in washing machines and them always breaking down........
a friends of mine years ago was a washing machine mr fixer and for servis. he said that if you use your machine more than 4 times a week, you need an industrial machine. they arent built to last continual use apparently.
they must be mad.0 -

Thats the only trouble with bank hols !
sandraroffey , thats the daft thing about 4 times a week .We do more small loads than less large loads thinking the machine will cope better .

Hi again, an update to this problem and hopefully the last .
Engineer came out and inspected last week .Confirmed bearings had worn .
Said bearing failure was a common fault after only four months on this model as there's a bad batch out there!
Unfortunately we've had two of them .Who says lightening doesn't strike twice
We refused a repair and contacted supplier. They said we could choose a different model from their website .If it was to cost any more than we'd initially paid we'd have to pay the difference.
Had our eye on a better name model but it was £60 .They wouldn't budge but would see the manager .
"Would 50/50 split be ok with you ?"
NO ! Mentioned seven engineer visits and our work time wasted plus our phone bills in that period and then we mentioned potential "contra charges " .
Result ! New upgraded ,better brand machine to be delivered on Saturday at no cost .
This ones also got a two year warranty
and they all lived happily ever after

Why are you sending a shi77y letter to them? Haven't you had it all sorted to your satisfaction? I don't understand. glad it was sorted, I wouldn't bother writing a letter on this occasion, you are sorted, they already know there is a problem, the retailer eventually did the right thingAlways ask ACAS0
