Dismissed on sick leave due to false allegations

Solicitors are pursuing my case to tribunal thank God, however on none of the reasons I thought may be possible. My case is going to be based upon the punishment was too harsh, rather than dismissal I am being told I should have had a written warning! Again they do not seem to be listening, there should be no punishment whatsoever as I did not do anything. I am a little annoyed on what they are using as the argument, and I do not see this standing up at tribunal. The disciplinary policy of my ex-employer stated that if confidential information was exposed, then dismissal would pursue. They recon my case is borderline 51% chance of success and if my employer provides further new evidence to support their case, then the insurance will pull out and I will be left to fend for myself.
I am not at all confident on the solicitors arguments and I still believe this will all fall through. Although I have never ever been told off or been in trouble before, I feel they will dig some false dirt in order to help themselves. These people are pure evil and dishonest, and the three managers involved are corrupt in that they will constantly cover each others backs.
As for the job interview, the company decided to slash the salary by £5k which I was not happy about. They have decided to pursue 2 low level, cheap candidates to 2nd interview, if they fail to reach the required standard, then they will want to bring me back. Bit fed up with this, but there were 7 candidates, so at least with my dismissal I still made it to top 3!
I had a surprise interview for a contract role on Friday also, again the salary got reduced by £5k compared to what was advertised, I hope that this is not something that is rife in the accountancy proffession at the moment. I still have not received feedback from the agency, I am guessing this is a negative. Again they had candidates who would accept less than what they wanted to pay. With a 46mile round trip to actually get to work, I could not afford to accept less than what I had previously earned. Am hoping to hear some positive news this week.DEC WINS: Food Show tics, 5 books, cd, signed villa shirt, £25 Wilstshire farm voucher, private tuition, Glayva, Card making materials, Matter Box, John Frieda Hair Kit, Wolves Tickets0 -
I hope you have positive new s Boopops too.
Im not liking the sound of this at all.
Have they estimated how much you are likely to get playing it this way?
I can see why they will do this, after all a results a result. But if you didnt do it i take it its "your word against ou"rs. and if they can drum up enough people to lie then....
all the best:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

Thanks Lynzpower. They have mentioned 2 amounts £500 and £300 and then loss of earnings. Compensation will amount to very little as I had only been employed 18mths. The main thing I want is to clear my name, I stand to be expelled from both of my Proffessional Accountancy bodies for this.
They will drum people up, as folk are scared of them. As I have said before, they dismiss people all of the time, i really do not know how they get away with it. I have never seen people dismissed like this before.
I still do not think the angle they are taking is correct, but having no experience of these type of things or the money to go it alone, I guess I will just have to see it out.
I have just had a call from the agency and the maternity contract role are keen to see me again. I am down to the final two, it is all to do with personality and who will fit with the team best. The FD thought I was a bit on the quiet and nervous side, but that is just because of all the trouble I have had with my previous employer. If I can get this 6 month contract and a good reference, I am sure the worst will be over and I will be able to move on and leave this all behind.DEC WINS: Food Show tics, 5 books, cd, signed villa shirt, £25 Wilstshire farm voucher, private tuition, Glayva, Card making materials, Matter Box, John Frieda Hair Kit, Wolves Tickets0 -
With this in mind hun I think you should get a second opinion off another solicitor. Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

Thanks. I think I will call the nice one I was obtaining advice from in the first place, let her see the documentation and see what her thoughts are.
My ex-employers are already bad mouthing me in references. Agencies have told me they are doing me no favours what so ever and with their reference alone, I will struggle to get another job. They have said that my time keeping, attitude etc are all poor, yet I have never been late. I only live 5 mins away and in fact arrived half an hour before start time everyday. Whats more, we had a clocking in machine. Most senior staff refused to clock in and out like shop floor people, however I never had issues with it and always used it without fail, the HR manager who has accussed me of this, arrived the same time every morning as me as she would always pass some comment.
I hope these guys receive the same treatment some day.DEC WINS: Food Show tics, 5 books, cd, signed villa shirt, £25 Wilstshire farm voucher, private tuition, Glayva, Card making materials, Matter Box, John Frieda Hair Kit, Wolves Tickets0 -
Youdefinately need a beter solicitor.
I was reading something the other day about "loss of reputation" http://www.personneltoday.com/articles/2010/03/08/54543/guilty-by-association-what-recompense-when-mud-sticks.html
Please make sure you are taking good notes of when jobs have been refused, who was supposed to have said what etc. Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

Cheers for this. Agencies who I have worked with before and one who has placed me in top roles on 2 occassions, will not represent me unless I clear my name and receive a letter from the court confirming this! They have said without this against me they would have no problem placing me again.
I have been suffering severe depression and anxiety since this has happened, my confidence is nil. Do they award for this suffering, do you know, if successful?
This solicitor emailed me inviting me to lunch on friday by accident. She then telephoned me regarding my case within 10 minutes of realising what she had done, just so she could then say she had sent me a second email in error and to delete it. I do not think she is obviously paying attention to her work. I have kept this mail in the event things fall through and shall use it in a complaint to the omnibudsman.DEC WINS: Food Show tics, 5 books, cd, signed villa shirt, £25 Wilstshire farm voucher, private tuition, Glayva, Card making materials, Matter Box, John Frieda Hair Kit, Wolves Tickets0 -
Yes, damages can be paid for distress. Have you had a diagnosis?
If you have no confidence in your solicitor then stop using her, try someone else, its too important to drift along if you are unhappy:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

Yeah I am seeing GP, CPN, have antidepressants and suffering panic attacks now. My Gp says I need referral to Cognitive Behavioural Therapy. The Occy Health at work said I was very fragile as a result of my surgery and the pressure from the accusations.DEC WINS: Food Show tics, 5 books, cd, signed villa shirt, £25 Wilstshire farm voucher, private tuition, Glayva, Card making materials, Matter Box, John Frieda Hair Kit, Wolves Tickets0

You say you worked there for 14 months? Given that we are in a recession, could you perhaps leave that job off your CV and claim you have been unemployed for the last 14 months, a few of those months are covered by recovering from your operation anyway?
You could say you left your old job as you were ill, then knew you could not work again until after you had recovered from the operation, which takes us to now?
Good luck with the interview. If it doesn't work out for you, consider my suggestion as it will mean they have no more control over your future?0
