Faulty item, but no returns accepted

    agree with above. I emailed a seller who had sold me an item grossly misdescribed. She basically told me to get lost 'tough luck ' because she gave no refunds. I opened a dispute through E Bay and got payment and postage back. I did lose out on having to send the garbage back but

    i agree, escilate the claim. if it was described as working and now isnt then it is not as described when you received it... if post office or courier to blame let him claim. you should get a full refund but do make sure that you get it tracked/recorded for returning as advised.
    if seller is a business seller they have to take returns, as i understand it. private sellers also have to list honestly, although as a buyer it is always a good idea to ask as many questions via ebay messages as possible to back up your purchase expectations.

    How do I escalate the claim? Is this done through Paypal? I have opened a dispute through the ebay resolution centre and don't see anything there.

    The seller just keeps sending me messages asking for proof of this and that. The item is a Sky+ box and he wants proof from an engineer that the box is faulty. He also wants proof that we've paired the box up with the viewing card, he's asked for the card number so he can call Sky himself.

    He's been in touch with his "friends" at Fife police (weird!)and knows we had bad weather recently and that there were power cuts in nearby areas. He's saying this is the cause, even though we haven't had any power cut. He wants me to get proof from Scottish Power!!

    My last box died, so instead of going through Sky which would have been costly, I bought a box off ebay. I'm beginning to wish I had gone to Sky now!

    I've not used the resolution centre since they changed it. There should be a link somewhere to get ebay to review the case. Someone may be along soon and give you a specific link.

    we had a similar experience with a "nice seller", she had 100% feedback. we bought a game that came with a gun and sensors, said it had been played once. when it came the game case was grotty and we couldnt get the thing to work, she had also listed no returns. she insisted that it worked fine with her.funny how most people with faulty items have a no return policy. in the real world if you sold something you knew to be working why wouldnt you offer a refund. go through the dispute and you will get your money back, but you will have to send back item tracked at your expense.
    consequently, afterwards she set her feedback to private!

    Just go through paypal-ebay keep all his emails to you 7 escalate to a claim as soon as you can. Was it very expensive? If he wishes to make all these enquiries he can, you bought something that was I presume listed as working, you received something that wasn't. It's SNAD. I expect his solicitor friend will be offering advice soon, if they know so much about the weather, ask for the summers forecast.
    It sounds as if he's trying to intimidate you. Don't let him.

    This is what I'm thinking. His profile pic is a group of police officers, so I'm assuming he is one or used to be. Plus he said he's been in touch with his "friends" at my local stations.

    Looking through his feedback, he sells electrical parts. So I wonder if the box has been faulty and he's tried to repair it to sell on. I might get in touch with one of my friends who work at Sky and find out the history of the box ;):rotfl:

    i wouldnt pay any attention to what he says, just escalate the claim in paypal, there should be a link which says escalate the claim although i cant remember where it should be on the page but it should be either at the top of where the messages are left regarding the dispute or underneath but it should definately be on there somewhere. as for his comments about the weather and storms etc, yes i do think also he is trying to intimidate you. i think if the messages are going back and forth on your dispute you just need to leave a final one stating that the goods you receive should be fit for purpose, it wasnt so you wish to know if he is going to refund your full payment for the product when you return it as if he is not going to do this you will escalate the claim and let paypal decide. when/if you do eventually send it back make sure it is recorded delivery or similar so that you have proof of him receiving it.

    Excellent. Just grab his full address, and make a report for threatening behaviour to the police. Provide copies of the emails he's sent at the time of making a report. If he is actually a police officer, he'll be immediately suspended. Scum like that shouldn't be protecting us.

    Erm yes, but back to eBay - file a claim. That is all.

    I opened the dispute through ebay, not paypal. Can't find any button to escalate. When it's my turn to respond, it just lets me reply to his message or close the case. I've emailed ebay asking how to escalate. I wonder if I should open a dispute with paypal then? Can you do that?

    I've done a bit of detective work and he bought a Sky box in December. As it's over 90 days, the number is just listed on his feedback page, but if you use google, it tells you what the item is and how much it was bought for! I love google!!:D Since then, he has bought sky box parts. So, I think he's sold me a box that he's tried to repair.
