Clearly this guy is breaking the law - I wonder if the police will do anything about it? I bet there's loads of images like this that could get people into trouble.
No - because it's not been witnessed by anyone, and they won't be able to serve a NIP on the Registered Keeper within 14 days of the offence, in any event. I wonder if the employers have seen it?0 -

Get a life
If it's a comb or a razor or something that still would come under "due care and attention" as did mobile phones before they made an unnecessary specific law for one kind of device.
Who cares, unless there's evidence that he actually caused an accident, just ignore it and move on. There's much more dangerous and stupid things happening on the roads every day. Lorry drivers generally know how to correctly use communications devices while driving in a safe manner anyway.
Also I believe it's still legal to make an emergency call while driving, maybe he's reporting a hit and run, or a suicide jumper on a bridge or something.0 -

This offence doesn't need a NIP. It simply has a 6 month limitation of proceedings.
Technically, the driver could be prosecuted but it would be a very difficult one to prove beyond reasonable doubt so probably wouldn't ever get of the ground. In either case, it's unlikely the matter would be before the court before the 6 month limit so wouldn't start in the first place.0 -
