Royal Bank of Scotland are grating on me!!!

Situation is:

I had a platinum credit card o/s balance £1300.00 (credit limit £2200)

To my knowledge I hadn't missed any payments but in June this year I received a letter stating that I do not meet the lending criteria for this card and they want there funds back. I questioned this and they said I had missed 12 payments in the past.

Obviously I disputed this and asked for proof. I did not receive a reply and asked my solicitor to request information. Letters were sent out on 22nd June 2006 and 11th July 2006. They replied on 30th July stating I hadn't met lending criteria but still no proof of missing payments. I personally made telephone call and informed them they were in breach of the data protection act as it had gone past 40 days. I got a snotty reply and she said she would send them to me.

The reason I am posting on here is because of the latest bank charges scandel, am I right to ask for all of my charges back on this account and my current account (I do not use this anymore)?

What I am worried about is that they will request the whole of the balance of £1300 immediately if I start spouting law at them. I also have a loan with then which I owe £5000 approx. I have never missed a payment on that either.

Can they do that? To my knowledge I have done nothing wrong.

Can anyone help??

    Did you send your letter to the data protection commissioner with the admin fee or was this a simple request for information? If it is the latter then there is no legal requirement for them to respond at all let alone within a certain timescale - though obviously good customer service says that they will.

    In almost all T&Cs I have seen there is a clause in the contract that the bank can withdraw facilities from their customers. RBS, as far as I am aware, have not stated any policy on people who are complaining about bank charges/ issuing court proceedings over them but certainly some of their competitors have publically stated that they will immediately close accounts of customers that complain and this sites own help section on this topic recommends that you have alternative arrangements in place to "immediately" repay any outstanding debts before pursuing bank charges.

    It doesnt have to be you that has done something wrong for you to be negatively hit. Because of all the people complaining about bank charges we are now seeing banks decrease charges but increase the interest on borrowing. For those people who are responsible and correctly manage their money it isnt "fair" that they must now take a hit because of those that are irresponsible.

    As well as these complaints however there is also complaints occuring that banks have been irresponsible in the amount of lending they have given to people. There have been a number of posts on here recently from people who have now had their credit withdrawn because of the banks reviewing their lending decisions and now deciding that people dont meet the new higher criteria.

    As the old saying goes... be careful of what you wish for as you may just get it.

  • Perhaps its a hassle I dont need and I should leave alone. I cannot at the moment afford to pay back the £1300 let alone the remaining loan I owe. It just incensed me the level of customer service I had from one of the UK's top banks!!
