    all the searching and question asking from the gov is really annoying/upsetting but i know it is req, i am waiting on a decision on the council tax benefit at the moment..... THANKS TO EVERYONE ON HERE FOR ALL THE ADVICE ..

    Do you have life cover for the mortgage?

    If so, then it may now pay out, depending on its terms and conditions.

    Check it and if it does, then claim on it!

    i have life cover for the mortgage but when i was young when taken out i didnt include the terminal.critical cover, i was a strong athletic youth and would never have thought of getting ill.... so am stuck with life cover till the end i think... am only 40 too

    Hi Scotty,

    So sorry to read of your news but if you do have the £16,000, you won't be entitled to Council Tax Benefit.

    However, as you have said it is intended for your family, have you sought legal advice? I know that some cases of Housing Benefit claims I have dealt with, money put into a trust is excluded from the capital calculation. I dealt with a claim from a lady who had £65,000 put into trust for her with a solicitor by her parents and she got income support and HB/CTB

    As you have been diagnosed with terminal cancer, you should make sure that you tell DLA as if you get the car, this means you get the mobility amount but are you getting the right level of DLA care if any? Depending on your prognosis, you can apply under special rules and get your claim fastracked.

    As said above as well, your wife may be able to claim carers allowance if she is caring for you but not 100% sure of the # of hours that she can work or has to be caring for you.

    It's higher care that terminally ill people get - if they meet the criteria for either mobility component, they have to apply for that. The part for personal care doesn't need to be filled in - there's a form (which I never remember the name of - D something?) that has to be sent off.

    my wife works 22 hrs a wk so we miss out on that but does the care allowance come outa my dla allowance if received or is it xtra, i get top mobility allowance of 119 p/w al i am claiming is ESA 95 pw and dla 119 pw ... its annoying that quality of life will have to suffer so much due to no fault of mine and ive worked since 15 years old with no time off until now.

    No. CA would only come out of means tested benefits - DLA isn't means tested.
