I sold a Blacklisted Phone ?!

  • Hey all, Thanks for the replys, This has helped me quite abit, I've got the money to refund him now, However he isnt replying to my emails, I've asked him how would he like me to give him the money, (Offered it by gyro Cheque, Cash in a secure envolope sent via Royal mail speical delivery recorded, Or would he want to collect it from my house << being the better option) as i want this sorted out asap, However i have received no response from him, So im guessing he's either reported me to the police, Or he doesent want a refund, or even maybe he's sold it on (which i definatly hope he hasent), However im not sending any money to someone who isnt willing to reply, As i'd hate to be scammed into loosing £120.

    I've been told to seek legal advice on what can be done about the situation in general, Seeing as i did not know that the phone was blacklisted nor stolen (It came with all the instructions, Box, Leads, Headphones, Software, So i'd imagen it isnt stolen, Possibly been subject to a non payment of a phone contract or somthing).

    I've also been told that the police cannot do much in this situation, And that it does happen alot on the internet that people will make money from insurence fraud, And leave the seller with what is practically a dummy phone, I've never been in trouble with the police, So im a little bit worried about what could be done.

    I appreatate all the replys i've recived, I'll keep you updated with what happens.

    you bought and sold in good faith
    you have the cash and have offered a refund
    put the money aside and wait for him to contact you
    forget legal advice,even if the police come i expect you explaining the situation is all thats needed

    In theory you could get charged with RESET (effectively handling stolen goods) being an unknowing victim isn't sufficient to get away with it, the age old if it looks too good etc is the stance that's taken so even though you've unwittingly done it you could still be charged. That said i'd be absolutely amazed if the police wanted to get involved, it's clear you've been duped and they'll see that, they're not monsters

    I might be stating the obvious, but if you do hand over the £120 to your buyer, please get a receipt for the money received.
    It may not help at all but could be useful as part of a paper trail.

    there are way too many mobiles being stolen on a daily basis,I really doubt the police would care much about your case even if reported. the guy you sold the iphone to probably has got the IMEI changed (yes,you can do it despite of being illigal in many countries) by some dodgy mobile shops or using software like ziphone. so dont stress youself out too much, just wait and see what the guy says when he replies to your refund offer. good luck.

    As above, so many items are sold online you won't get charged with handling stolen goods, it was brought in good faith and done online so you never inspected the goods. This was not a "hist, over here buddy" in the pub.

    Report it to EBay, and let them handle it from there.

    Do keep the £120 to one side for the time being, if he hasn't got back in touch within say 3-6 months, then i would forget about it. You cant be expected to hold onto it forever. The buyer could have sold it on, maybe he talked to the network that reported it stolen and handed it to them.

    Importantly, do get a receipt and have them sign it for any money that changes hands.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
