Bought trousers from Ebay but they are smaller than advertised.

Hi all,

I recently bought some designer trousers for my OH off ebay. They were brand new with tags. They are listed as a 38R - 38" waist and 32" inside leg. The pictures of the trousers in the listing clearly shows on the tags that the trousers are a 38.

I received the trousers today and OH tried them on and to his dismay they were extremely tight - how could this be? He already has a pair of 36 of the same brand of trousers that are too small for him so we thought the 38 would be perfect.

I measured the trousers (after he managed to unpeel them lol), and they measure exactly the same as his size 36 trousers.

One thing that is strange is only the cardboard tags have the size on it, there are no sew-in labels in the trousers with any sizes on them, so it is possible they could have the wrong tag on them.(tag is attached with safety pin.)

They also don't have a care label inside them, his 36 trousers do.

They are also a 34" inside leg - far too long for him!

I have messaged the seller explaining the problem however on their listing it states they don't accept returns. They have a ebay shop so I assume they are a business seller - can you have a shop with a personal account?

Does anyone know what my rights are? What would you do in my situation?

I am left with a pair of trousers that are too small and very long(unless he loses half a stone and grows 2 inches) and £35 out of pocket, not to mention panic as now have to find another pair of trousers for my OH to wear at my sister's wedding next week!

  • If size is wrong out of decency they should refund, have you contacted them?

    Having said that they might not have measured the waist exactly as they went by tag size!

    I once bought 36" waist from Next and my mate who's 32" could hardly fasten them and all tags labels said 36" so mistakes do happen!

    I would ask them and see what they say and you can also file a claim with Ebay as goods not as described and reach a compromise between you.

  • I have already messaged them - hoping to hear back from them soon. I really hope they offer me a refund, I don't care about losing out on the postage - £6.50 to get them delievered Special delivery, plus whatever it costs for me to send them back. I just want them out of the house then my OH will stop being in a bad mood - thinking he must be a size 40!

    Wrong size and no labels, - are you sure they are genuine?
    Open a not as described dispute, you'll have to send them back tracked at your expense, and will get a refund of your purchase price and the original postage.

    Just as an aside. This is not true. Feedback can be set to automatic, mine is.

    Plus, if you open a SNAD dispute (don't go for counterfeit as it leaves you 10 days to prove it), your only cost will be the return of them to the seller. The initial payment, including your original postage payment will be refunded.

    It's not on automatic unless it takes 3 or 5 hours to automatically be returned. When I've left feedback for a buyer and their feedback is set to automatic it gets returned straight away.
    No I'm not doing a counterfeit SNAD, I am doing one based on the size is completely different from the listing. I agree, it is difficult to prove that the item is counterfeit in 10 days.

    It's funny as when I received the item I got a little bit of paper with it from the seller, which includes: "If you are not happy, then let me know and I will do my best to resolve the problem. I hope we can deal with each other soon.". I will re-write it as " If you are not happy, don't let me know, as I will ignore you competely and not bother to resolve your problem. I hope I can rip you off again soon." :mad:

    I still haven't heard from the seller, and they have items that have ended over the past few days - more proof that they've been on ebay.

    I have checked their feedback on goofbay, there is a negative from a while back where some had to open a dispute and it says 'seller dragged feet over dispute."

    Looks like they don't really care at all. As long as they've got their money they are happy. So many people like this about. Oh well what comes around goes around!

    It's not on automatic unless it takes 3 or 5 hours to automatically be returned. When I've left feedback for a buyer and their feedback is set to automatic it gets returned straight away.

    As a Titanium P/seller with big volumes per week, I can say that feeback sometimes is instant, other times can take up to 24 hours. All the settings I have are automated. There is no strict time limit, but you can NOT assume the seller left the feedback manually.


    I still haven't heard from the seller, and they have items that have ended over the past few days - more proof that they've been on ebay.

    You have NO concept of automated Ebay. Sorry. But that is a FACT.

    Well they are not a 'titanium' seller, they are a private seller. They do not sell volumes of items so please don't ASSUME either!

    I only have an address for them, no valid phone number so cannot ring them.

    I have opened a dispute but they have ignored that, so someone that sells items and doesn't check a) their emails. b) their ebay must really struggle to post items on time, sell things on ebay etc etc.

    Unless automated ebay means that ebay fairies package your items up and send them to the correct address without you checking your emails and ebay? Wow automated ebay sounds great, might give it a try!
