Further to my previous post a couple of days ago where my hubby has bought a 'phone on Ebay, not received, no reply to emails so calls the seller who claims to know nothing about any phones and reckons his account has been hijacked. As advised, opened disputes with Ebay and Paypal and escalated straight away.
BUT - look at this in the Paypal blurb re Eligibility Requirements:
If the Claim is decided in your favour, your recovery is limited to the amounts that PayPal can recover from the seller's Account.
Does this mean I am stuffed then, assuming this guy is telling the truth, the money will be long gone from his account.
Any help gratefully appreciated, am really worried.

I think that's only if you paid with paypal outside of Ebay. If it's an ebay item you'll get your money back in full under the buyer protection scheme.

Thanks for the link, but that piece of text was actually taken straight from the Paypal resolution centre. (I did pay with Paypal).
I meet all Ebay requirements for a refund , but the seller's page, although offering Paypal as method of payment, does not say the following:
The “This item is fully protected when you pay with PayPal” message is displayed in the seller listing information.
So, what do you think my chances are of getting a refund? Any help gratefully received.0 -
It changed last year even off ebay sales are now covered if there is money in the account or notpaypal wrote:Before 1 November, if you bought an item off eBay and didn't receive it, you could only get back the funds if your seller had them in their PayPal account. Now if you make a dispute or claim that is valid as an item not received and win it, you will be reimbursed under buyer protection. This is the same protection you'd get through on eBay protection for items you haven't received

Felicity you were actually looking at the wrong part of the user agreement as that was the bit that used to apply to off ebay sales (they havent changed it) There is a separate bit for ebay sales. As I said anyway there is no difference in claiming now for not received items on or off ebay (you still cannot claim for not as described off ebay)

What is the item number?
Did you pay as stated?
Send the payment to the seller through:- The eBay “Pay Now” button or the eBay invoice, or
- The “Send Money” button of your PayPal account by selecting “eBay Item” and entering your eBay User ID and the eBay item number
- Look for the buyer protection message in the eBay listing. If you see this message and you meet the eligibility requirements, your item is eligible for PayPal Buyer Protection. You can view this message in the listing after you complete your purchase by logging in to your eBay account, going to “my eBay,” then “won,” and looking at the listing. If the listing does not include the buyer protection message, then it is not eligible for PayPal Buyer Protection.
- Not all eBay websites offer PayPal Buyer Protection. If you purchase an item on an eBay site other than eBay.co.uk or eBay.ie, your eligibility to receive a payment and the terms applicable to you, will be dependent upon the terms of the protection programme set out on the eBay site where you placed your winning bid or where you purchased through the ‘buy it now’ feature. If paypal fail to refund and your payment was funded with a credit/VISA debit card you could ask the issuer to instigate a chargeback0 -
Thank you for your help. Listing does not display 'you are protected by Paypal' so looks like we are not eligible. I have looked at heaps at listings this afternoon, nowhere can i find this 'you are protected by Paypal' sign. Can someone show me please? Think/hope I am missing something here.

Look at the 'payments' section on the listing page. Next to paypal symbol it says 'Learn more.' If you click the link that appears to suggest you have buyer's protection.
As far as I can see, no listings state the buyer protection explicitly anymore, although they did back in the day.
I'm confident you will get a refund.

Doh, thank you so much. I had imagined a large 'banner' somewhere, not 'buyer protection' in small print at base of page.
Hopefully will be ok, but was saying to hubby last night, what happened to Ebay being safe to buy on? Call me naive but I thought Ebay/Paypal had really tightened things up. In all my years buying and selling on Ebay I have never experienced this and tbh it's put me off big time buying again.
