Help with Paypal case please - I've been scammed

Hubby bought a 'phone 8 days ago, paid using Paypal. No reply to various emails, no 'phone arrives, so he calls the seller who claimes he's had his account 'hijacked' and knows nothing about this. Apparently, his account sold 9 'phones within a short space of time that day.

Have opened a Paypal dispute, my question is as I can't find anything about this, do you have to wait 7 days before escalating the claim? I seem to remember you could escalate straight away, which is what I'd like to do, but don't seem able to do so. Has this changed?

Also, will we get our money back if in fact this account has been 'hijacked'? Am worried, can't afford to lose this money.

    Hi,
    Im sorry but i dont know how long it will take paypal to sort this out but dont worry about the money. Even if the other persons account has been hijacked paypal will refund the money to your account once it has looked it to it and and made a report on what has happend.
    It works a bit like your credit card. Were if any scams or frude takes place then the credit card company picks the bill up and you are not left out of poctet.

    Im sure taht someone on here will give you more details on how it all works.

    Opening an Item Not Received claim with Paypal was the right thing to do, I'm not sure how soon you can escalate but do so as soon as possible (if the hijacked seller's notified ebay, the escalation could be sped up, not sure though).
    If the seller can't supply a tracking number (which they can't, if nothing's turned up), you'll get a full refund.

    Even if the seller's emptied their Paypal account, you'll still get refunded and Paypal will chase the account owner for the money after refunding you.

    You will get your money back, as DaveAshton quite rightly said. Escalate as soon as you can. Don't worry - you'll get your money back

    Thanks for your replies. Any idea how long we'll have to wait before the refund? The amount is already on my credit card.

    Hmm, don't think Paypal can refund directly to a CC. The money will go back into your Paypal account as soon as the dispute's closed in your favour, then you'll have to transfer to your bank account from Paypal (4-7 days, as a guide), and then pay it off when the funds land in your bank account.
    Back on MSE after a 5 year hiatus.

    They can, I had a refund the other day that went straight on to my credit card without even asking me.
