Redundancy processs ?

Hi all

I was told on thursday 25/03/10 that my position at work , and also someone elses position are to be made redundant , and a new position will be created . I thought that my performance and attidude was satisfactory and there were no issues regarding my role , how wrong i was .
I was also under the impression that i should have been consulted at least , regarding redundancy . Instead they just called me into the office and gave me a letter and a quick explanation and reasons for redundancy.
you know , streamlining ! anyway the letter states that my position is being made redundant on the 30th of april. They did say i could apply for this role , but i know feel really unwanted by this company , i dont think i could fill all the new critera .
can anyone give me a bit of advice please , i have worked for this company for nearly 7 years .
however i am currently suing this company for a injury at work,(2008) and i think this mite have something to do with it ?

I didnt even get a handshake for my efforts .typical

    you seem to thnk the company is out to get you and this influences you.
    (they might be but don't asume this)

    break it down and consult(you can lead)

    Is there good reason for cutbacks/combine the jobs
    If not question why and discuss the reasons(consultation use)

    Does the other person want the job? (handy if they want to leave)

    What package is on offer if they eventualy make you redundant?
    You are due 7 weeks notice so the will need to pay you some PILON if they want you leave end April and outstanding holiday pay.

    Still a log of other issues.
    when did you start?
    Has the injury effected your role?

    I started working for them in april 2004,STOREMAN/LOGISTICS (6 years sorry) the company was operating with at least seven staff , last august they decided that redundancies and a 10% pay cut would be the way forward , i agreed the 10% cut and 2 of my work colleagues were made redundant .
    then told my job would be safe , and was even told that a bonus would be paid in jan 2010 (AND WAS PAID )and an increment in april /may ! (Didnt think this meant redundancy)
    Anyway the reason why there making me redundant , is the broaden the the role that i do !LOGISTICS MANAGER and the other persons role will be going abroad to head office (thailand), she also thought she was doing ok .
    The injury , i think has had an impact on the relationship between employee and employer ,and my capacity to do the job has not been affected , apart from time off with the injury .
    I have'nt been told what package i will get yet ! is there a time limit ? and also , what would be the best way forward ?
    I am going to try to make contact with acas , if i can get through ! or CAB .

    What reasonable time off can i have searchng for another job, is there a limit again?

    One thing that occurs to me is that you took a 10% cut in salary last year, so which salary will they use to calculate your redundancy figure ? It might make quite a difference to the final pay-out.

    ACAS are very helpful - you could check out the website or call their helpdesk.

    Only if they have an enhanced redundancy package the statutory is capped at £380.


    Looks like a legit reason for the potential redundancies.

    I think you have to try and put to one side the I am not wanted it is a normal reaction to redundancy but in most cases it is just the needs of the business, the accident makes this harder but should really try to keep this seperate.

    You need to focus on what is best for you and consider all the options.


    Think about the job, can you do it, do you want it, if yes then you need to be keen and be profesional and try to make this job yours.
    Do they have someone in mind(so even if you apply you won't get it)

    Is there a chance to stay on till they do find someone and train them more time to find another job

    Remember if you can't do the job and take it then you risk a disiplinary exit later.

    There is also the right to a trial of 4 weeks so thins may be another option to see if you can do the job they want doing.


    If you don't/can't then you need to focus on the exit plan and making sure you get the coorect pay off.

    Ask for details of the redundancy package they should give you this.

    Lets start with the notice, if the letter was official notice then they may have made a mistake.

    Notice starts the day after the day you get it so Friday 26March-30th April is 5 weeks 1 day but you will have had 6 years service by the 30th April(based on I started in April 06) so if they don't get this right you will need to chase it up.

    You should also get paid for any unused holiday this will depend on the holiday year how much you have taken ther is aminimum 5.6weeks prorata which for a 5 day week is 28 days.

    Don't forget that you accrue holiday while sick just in case they say you don't.

    Redundancy should be 6weeks pay but this is capped at £380 for statutory they can improve on this.

    You still needto contact ACAS/CAB to check on things especialy the potential link to the accident claim.

    Just phoned acas , and i might have made a mistake :o

    My letter reads from company -
    It is with regret that i inform you that due to the necessary streamlining and reorganisation of the company's activities , we CONSIDERING:omaking your position redundant form the 30th of april.

    Although there is an advertisement regarding the new role :(

    I was under the impression , with what my CEO said " HR will work out payment and any other issues (holidays)and give you a date" , that i was being made redundant.:(

    acas seem to think that , they have not made me redundant yet ! there only considering it :p.

    Really confused now, about it all !
    Suppose i'll wait , for the correct info and notice date

    Forgot to ask/mention when they made the other redundant last year were they fare and what package did they get.

    I think you are at risk and if they can fill the new position thne that will be it unless there is another role.

    Ok , quick update :p

    I am now in the coonsultation period ? , what am i supposed to do?
    do i appeal ?:o
    I know the company i work for , and the new position would be far too much work load :( sometimes i dont even get my lunch .doing the single role now
    so taking the new role is not an option.

    I have however been informed ( i know tittle tattle:p) that one of my fellow employees knew about my "consideration for redundancy" on wednesday, :rotfl:not staff , but sales :(

    The other fortunate ones were made redundant , no probs at all , 1 served 6mths , and the other 3 .

    Well at least they are being decent(ish) so far.

    Consultation is about trying to find way to avoid the redundancy or make the process as painless as posible for both side, not allways easy a good test of your negotiation skills.

    1. So you try to protect your job or get a new one in the company.
    2. You try to get as much money as possible if you do go.
    3. they try to make sure the company keeps running


    One thing I always remind people is that the people you work today you may be working with again so it is not a good idea to burn bridges even if you hate the place and some of the people.

    So trying to protect you position,

    If you think the new role is too much for you then that is easy you don't apply. You could raise this if you believe that no one could do it and that the current role is allready a full time and that business will suffer if they proceed since no one will be able to do it. It could be that someone higher has been told cut costs and this is what they came up with so it will fall on deaf ears they will do it even if it won't work(got any contacts in head office?)

    Money usualy the best way here is to be flexable in return for PILON.
    That way they get to keep you for as long as they need(find someone to do the job) and you get redundancy and some extra notice money.

    If they insist you work notice you are entitled to 2 days paid leave for job seeking related tasks(can be over more days), more than this can be taken unpaid but a decent employer will still pay if you get the job done.

    If its ok , i will keep posting updates, on the procedure and the trials of being made redundant . To help other folk that might experience this .

    update

    I recieved my notice monday 6.04.10:( and i will be unemployed from the 30.04.10, they are paying my redundancy, £1923 and also paying my notice in liew .6 weeks :).
    Can someone confirm when my last day of payment will be , ive worked out round about the 19. 05.10, not sure though.

    they have also stated that i can have 2 days of for job hunting , so i hope i'm getting a good deal.
