Just wanted to say I won my appeal at PATAS this afternoon "Procedural impropriety" as at the time of parking I was able to download an old map showing incorrect parking zones. It's worth appealing provided you have done your homework. Thanks to Coupon-Mad for all the advice.

That is quite interesting as the adjudicator seems to have attached procedural significance to the content of a council web site.
The text of the full adjudication would be most welcome.

Thanks all I will post it here and on Pepipoo when I get the writen confirmation in the post. Not sure it will help anyone else for this particular area as the link on the website has been changed, but it is useful for future cases.

It is the adjudicator linking website content to the PCN process that is of interest.
The specific content n your case is no longer the issue, there are a lot of council websites out there with poor information.

Got the written judgement today, it is fairly specific but very fair:

“The authority’s case is that the Appellant’s vehicle was parked in a restricted street during prescribed hours when in Harmood Street on 25th march 2010 at 20.02.

The Appellant’s case is that she had checked the authority’s website 2 days before the contravention and also after the contravention, and the Controlled Parking Zone map indicated that the restriction ended at 18.30. The Appellant has produced the website map that she downloaded and this has been exhibited.

I have considered the evidence and I find that this PCN cannot be upheld.

Whilst I find that the authority’s CPZ signage in this zone is correct I find, as a fact, that the authority’s website was giving out inaccurate and misleading advice that was contrary to their CPZ signs.

I understand that shortly after the Appellant brought this to the attention of the authority the incorrect map was removed from the website.

I would refer the authority to the Appellant’s letter of 20 May 2010, which was received by them on 4th June 2010. The Appellant raised this matter of the website inaccuracy and this was not addressed in their notice of rejection.

In the circumstances of this case it would be wholly inequitable to uphold this penalty charge notice.

    The appeal is allowed.”

The adjudicator asked me what I had expected the authority to do when I had pointed out the incorrect information on their website, I said that I had expected them to say "Thank you for bringing this to our attention, we have amended the incorrect link on the website. We have also cancelled your PCN and apologise for the inconvenience", the adjudicator laughed!

    Hope this helps someone else.

    Thank you for posting this.

To be usable for others we do need the case number.
  • Hello

I have just gotten back from a cheap night out watching my friends in a band. All had gone well until the £60.00 ticket on the dashboard

Same street, Harmood. Same thoughts: no signage, no controlled notice, no kerb markings and I've parked there before.

Now that the map has been taken down from the website do I have any other recourse? Seems very unfair to me not to have road signs stating controlled hours?

Be grateful of any help on this one

I take it yours is also a Council PCN?

Have you asked about this on pepipoo.com daruma? That's where the experts on PCNs and lines and signs are. There are usually avenues of appeal:

Best of luck with your appeal, IMHO take pepipoo advice first.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hi everyone,..
I parked in Harmood St Camden
myself and my brother checked for any signs in that particular road
parked at 21.00 in a line of cars on the single yellow line...
caame back at 23.45 did not see the ticket until the next morning
contacted camden council they say that I should of observed the CPZ signs!! I did not even know that they existed, having read this I am still going through with appeal as the first appeal has restarted and I have less than 14 days left.
If I use Patas what is the best way to do this??
    many thanks in advance
I really cannot afford to pay £60.

Unfortunately, local authorities do not have to erect street signs in a CPZ unless parking restrictions are different to those posted on a CPZ sign. The restictions in the zone where Harmood Street is in are in force until 11pm 7 days a week. CPZ signs are only placed at the entry to zones and some can be up to 3 miles from a street in that zone. It is scandalous that Local Authorities are making a fortune out of uninformed motorists, but that is the law and I can tell you now that PATAS will not uphold your appeal unless there are extenuating circumstances, ie. the sign was blocked from view. My advice would be to pay up and like everyone else you won't do it again otherwise it will cost you £120! Always best to check LA websites on parking that give you the times of when you can park.

Before you just pay, copy the pcn, both sides, remove personal bits and post on pepipoo.com. Although its a cpz its quite likely the council have made errors on the paperwork which may help you.
