We would not generally expect a firm to use ‘set off’ before giving the customer a reasonable opportunity to pay the debt. However, what is ‘reasonable’ might depend on the customer and the history of the account.

hmm seems harsh i had only one letter the other day and have had the card for years never missed a payment on any thing in over 10 years easy only have a very very small debt semms like they fot it in for me ohh well lesson learned

Don't be so silly, they have not got it in for you. You broke the terms of your agreement, they even wrote to you to tell you this. Banks are businesses, they don't do hugs and soothing sounds!

Sorry some of the replies haven't appeared overly sympathetic.
However the advice is to always keep your creditors informed.
They cannot help you if they don't know about your situation.
Did you tell tehm about losing your job?

well according to them they cant the person i spoke to said no we cant do that its your money ??? and no its possible they dont want to come to an agreement but you cant get blood from a stone no one want to lose there job but these things happen
Sorry, but whoever you spoke to was wrong.
That CAN offset from your bank account if they want to and there is nothing legally you can do.

They cannot touch the money if it is benefits though.

Having just read through your replies on this thread, the best advice i can give is this.
Let the bank take what they want from your account!
You and your family won't starve as that MASSIVE chip on your shoulder could feed a town for a month.

You're probably right, but it's not always obvious from the definition what it actually means.

We're talking about Barclaycard Terms and Conditions where it does say:

5.6 If any amount remains outstanding, you authorise us to offset such amount from any amounts that you may have in credit in any of your accounts with the Bank.

Not knowing what a clause means doesn't make it invalid of course :)

Why did you feel the need to edit your post to add that garbage at the end? You almost made it all the way through and offer something constructive.
