HELP PLEASE !! Vodaphone phone falling apart

Hi there....
Could someone out there please advise me on what the best course of action and my rights are.
My son bought and paid for his 1st mobile contract just about 6 months ago. He is paying £40 per month and is tied into the contract for 18 months. Anyway he got a touch screen phone as part of his deal and now the phone is basically falling apart. The edges surrounding the phnone came off first and now the touch screen phone as a result has become very loose and is falling off.
He wanted to deal with this himself (although he is quite quiet and not forceful at all) and went into the Vodaphone shop where he took out the contract and basically they were not interested in the least. They eventually said that they might send it back and see if it was a Manufacturer's fault and if they decided that it wasn't he would be charged for the repair.
Surely after 6 months of use, then the phone is "Not fit for the purpose for which it was intended?" Can someone tell me if I am right here ? and any other substantial argument that I can make on his behalf.
I feel that I am walking into a minefield as I am not sure of our rights in this case and the phone in its current condition if only fit for the bin and he still has another 12 months to pay for the contract.
Any good advice would be very much appreciated.

Hi there.....He's working at the moment, but my hubby thinks that it's a Nokia 91? He a young professional person and takes care of his belongings, so it's not abused in any way, but I would say that he does use it a lot because he has lots of friends and they are always texting etc.
I haven't checked the internet for problems....I'll have a go and see what I manage to find. You could try the Nokia website and check the warranty status! it will ask you for the IMEI no and then you could try and send to them for repair! if they cant repair it they will just send it back in the same condition.
Alternatively you could just visit a local phone shop (usually fone fun or something similar names) not linked to specific networks and dead cheap! they may be able to replace the phone casing for a relatively low cost.

I'm sorry to hear that your sons phone is falling apart!
This is not something that we want your son to have to put up with for another 12 months and I would like to help you further. As I will need more details about the handset and the account, could you or your son please let me know these details -- Whether you or your son is the named account holder.
- Which handset your son is using.
- The IMEI number of the handset. (Can usually be found under the battery.)
- All issues that you're having with the phone at the moment.
