i think if the op feels really strongly about this, he should contact consumer direct for advice and put his case, explaining that he only went ahead with the booking, on the basis that the hotel was clearly described as "brand new".
i don't know what the chances are of success, but if you do contact them, let us know how you get on.0 -
If a TV lasted as long as a building say hundreds of years then no one would care! Buildings don't go out of date in a few months either. Your arguements a load of rubbish! I completely agree with you that if they stated its brand new then they are falsely advertising to get bookings and I would write back to them again. If they stated its "new" rather than "brand new" or "newly built" then you might have a problem as the argument then becomes about the definition of "new" and could be construed differently by the hotel and the customer.:smileyhea0 -
the last time i stayed in a spanish hotel that had thousands of british and german tourists traipsing through it every year, for the last 10 years, it certainly didn't look brand new.
but then i knew it was that old when i booked it, so i had a good idea of what to expect.0 -

The hotel gets pretty good reviews, and the interiors certainly do not look ten years old. If it was not for the location, I would stay there, and I have very high standards.
OP, again, is there a reason why you do not want to stay in the hotel? Is there a brand new hotel in the seaport area?Gone ... or have I?0 -

RL290 - Why should it help you to know my reasons for wanting to stay in a hotel that has been described correctly? The legalities shouldn't change depending on my reasons.
If someone sold you a TV as brand new and you found out that it wasn't (even though it worked just fine) then I'm sure any normal person would have an issue with that.
My question is have I been mis-sold an item, and if so which company is responsble for providing a refund.

Ok, here is some constructive feedback....
Clearly the website is refusing your requests. Assuming your contract is with them (and not the hotel?), and you have exhausted all complaint options, your only remaining line is to take them to a small claims court. However, in making your claim, you will have to come up with a pretty good reason why the age of a hotel has led to a theoretical financial loss. So, answer my earlier question regarding why you think you have suffered from receiving accommodation at a hotel that is 10 years old instead of 3 years old, and then we can advise you of how to make your claim.
My impression is that there is no good reason why a 10 year hotel should be in any way inferior to one that is younger. First, I actually think that OLDER establishments are usually better because they have a proven track record. Second, the "brand new" claim is quite a subjective one: for all we know, most hotels in Barcelona were built before the 1992 Olympics, and this is one of the newest builds in the city!

Op how did you pay for the room as you may be able to fall back on your credit card provider.
At the end of the day we all like to get what we have paid for. I would be inclined to pay more for a brand new hotel (new fittings, new mattresses etc) and at the end of the day the OP made a decision based on the information provided..
And perhaps Laterooms are charging less because they are not try to pass it off as a new hotel.0
