Help needed with deposit!

I am new to this so please go easy on me - and apologies if I am in the wrong forum.

I have recently moved from a good home where I had privately rented for 7 years quite happily, into another privately rented home. I moved as it was a nicer area for myself and my son, and a much safer place for him to grow up.

Unfortunately I know the owners daughter and she is quite a fiesty character.

For reasons I cant be bothered to go into (sick of talking about it!), the owners daughter fell out with me and the owner has now issued me with a Notice to Quit.

I was a month behind with my rent (due to HB being processed S L O W L Y!!!!!) so they have every reason to issue me with a Notice to Quit. To be perfectly honest, it has been horrible living here as I was being made to feel like I should kiss the daughters feet with gratitude for 'getting me' the house! Also, the daughters husband has been coming over late at night and hammering on the door wanting to talk to me about 'the situation' - I have been issued a Notice to Quit and am trying to move out (still have another month till need to be out) so what is there to talk about?

So to cut a very long, boring story in short, this is the crux of it:

I have found another house I can move to.
I have £750 (by skin of my teeth) which could either be month in advance or deposit.
I am short the other £750.
The council wont pay my deposit as it is above the LHA of £650.
I have noone I can borrow the money from, have crap credit rating due to being an eejit at uni so cannot borrow from a bank.
I have applied for a Crisis Loan and a loan from the Credit Union (found through my church) and am awaiting news from this.

I am wondering if anyone knows any other option I could try. I have to move out as am not sleeping and so stressed living here.

  • The LHA is there for a reason. As you are skint, you should really be looking at somewhere which is £65 a month or more less than the LHA so you can collect the £65 extra.

    How will your situation improve when you would be throwing away £165 a month in this overly expensive new property ?

    Only way you will get any help is if your council offers a rent deposit scheme, they pay it for you and you pay them back weekly.
    LHA wont pay it as you need to pay the deposit and first months rent up front before getting the tenancy agreement and applying for LHA.
    Are you working? Do some overtime? Keep your outgoings to a minimum for a while to save up?

    When does your AST expire? They are usually for 6 months and while an S21, Notice to Quit, can be served at any point, it is only valid from the end of the fixed term. The reason I ask is you have indicated you have moved there recently so I wonder if you are still within the fixed term or whether the expiration of the notice you've been issued with coincides with the end of your contract.

    Also, did the landlord protect your deposit in a tenancy deposit scheme (if the property is in England/Wales) and did you receive notification which scheme its in?

    It would seem to me that your local authority consider that the accomodation is unaffordable on your income and so they don't think they are able to assist with your deposit as they see that you will fail in the new accomodation.

    I understand that you need to move and if you are on the housing register, being given notice will give you extra points.

    You may need to look for alternative accomodation however as if it is too expensive, you won't be able to manage longer term.

    Some landlords in the private sector do allow people to move in who can't pay a deposit and say that if you can pay £50 per month for example, extra to your rent, they will put this money into a rent deposit bond when you have the whole amount. This is not something any landlord is obliged to do as it places them at risk should you default and leave the property before paying the full amount and you have no protection until you pay the full amount and the deposit is bonded but it might be worth thinking about?
    I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.
